Amazon’s insurance position: Who pays after an accident?

Insurance responsibility depends on the driver’s employment status and whether they were on duty at the time of the accident. Here are the main scenarios:

1. The driver was an Amazon employee

If the driver was employed directly by Amazon and working at the time of the accident, Amazon’s corporate commercial insurance will usually cover your claim. Amazon carries substantial liability cover (often over £1 million per incident) for accidents caused by employees on duty.​

2. The driver was working through Amazon Flex (self-employed contractor)

Amazon Flex drivers are not employees and must arrange their own Hire and Reward (H&R) insurance for paid delivery work. When they are actively making deliveries, their H&R insurance is the primary cover. If the driver’s insurer refuses to pay, Amazon Flex insurance may step in as secondary cover. You will need to provide evidence that the driver was on an active delivery block at the time of the accident.​

3. The driver worked for a subcontracted courier firm

The courier firm’s commercial insurance is responsible for covering accidents while drivers are working.

4. The driver was off duty

If the Amazon driver was not working at the time (for example, using the vehicle for personal errands), only their personal insurance applies.

How much compensation can I claim after an accident with an Amazon delivery driver?

Compensation depends on the severity of your injuries and your financial losses. There are two types of damages: general damages and special damages.

General damages: This is compensation for pain, suffering and loss of amenity. The Judicial College Guidelines provide brackets for different injury types. As a rough guide:

  • Minor whiplash: £1,500 to £3,500
  • Simple leg fracture (full recovery): £5,000 to £15,000
  • Moderate fractures requiring surgery: £15,000 to £60,000
  • Severe or life-changing injuries: £60,000 to £200,000+

What should I do after an accident with an Amazon delivery driver?

Ensure safety and get medical help: Always start by checking everyone’s safety and getting medical attention if needed. See a doctor as soon as you can, even for minor injuries — their records are vital for later claims.​

  • Call the police: By law, you must report accidents involving injury or property damage. The police report is important evidence for your claim.​
  • Gather evidence: Take photos of the scene, your vehicle or bike, injuries, road conditions, and the Amazon van or car. Ask witnesses for their contact details. Can I claim if the Amazon driver denies fault?

Yes. Even if the Amazon driver or their insurer disputes liability, you can still pursue your claim. Your solicitor will gather evidence (such as witness statements, CCTV footage, police reports and accident reconstruction analysis) to prove fault. Many disputed claims are successfully resolved through negotiation or, if necessary, court proceedings.

Do I need to contact Amazon directly after an accident?

It is good practice to notify Amazon as well as your own insurer. Amazon will open an internal investigation and confirm the driver’s employment status and insurance details. However, you do not need to handle this alone. Our solicitors can make all notifications on your behalf and manage communication with Amazon, their insurers, and your own insurer.

What if the Amazon driver was using their own vehicle?

If the driver was an Amazon Flex contractor using their own car or van, they must have both Social, Domestic and Pleasure (SD&P) insurance for personal use and Hire and Reward (H&R) insurance for commercial delivery work. Your claim will be directed to their H&R insurer in the first instance. If the driver did not have proper insurance, it’s usually possible to claim through the Motor Insurers’ Bureau (MIB), which compensates victims of untraced and uninsured drivers.

 

Will my claim be covered by no win, no fee?

Can I claim if I was partly to blame for the accident?

Yes, you can still claim even if you were partly at fault. The law applies “contributory negligence,” which means your compensation will be reduced by the percentage of blame attributed to you. For example, if your claim is worth £10,000 and you are found 20% to blame, you will receive £8,000. Osbornes Law will argue to minimise any finding of contributory negligence.

How long do I have to make a claim?

The legal time limit for personal injury claims is three years from the date of the accident. If you do not start your claim within three years, you will usually lose your right to compensation.
