Polytrauma claims are valued differently from single-injury claims. The Judicial College Guidelines provide bands for each individual injury, but courts will rarely award the sum of those figures: where two or more injuries overlap in their effect on your daily life, ability to work, or need for care, the total award is typically discounted to reflect the combined rather than additive impact. Getting that valuation right takes specialist medical and legal input.

The complexity of these cases means evidence has to be coordinated across several specialist disciplines, rehabilitation has to address competing demands, and the timing of settlement has to wait for the long-term picture to emerge.
What is a multiple injury (polytrauma) claim?
A polytrauma claim is one where a single accident has caused two or more significant injuries. Some of the patterns we most commonly see include:
- Head injury or brain injury with concurrent orthopaedic fractures (typical of road and pedestrian accidents)
- Spinal injury combined with internal injuries or multiple fractures (typical of high-impact crashes and falls from height)
- Loss of sight, hearing or other sensory function alongside physical injuries
- Significant physical injuries with secondary psychological injury (PTSD, depression, anxiety) caused by the same event
The reason polytrauma is treated as its own category is not just the number of injuries. It is the way injuries interact. A back injury that limits physiotherapy progress slows recovery from a knee injury. A brain injury that affects concentration may prevent compliance with a structured rehab plan for orthopaedic injuries. Compensation has to account for these knock-on effects, not just each injury in isolation.
How polytrauma claims are valued
The starting point is still the Judicial College Guidelines for each individual injury, but courts apply two further principles when valuing the claim as a whole:
The totality principle. Where injuries overlap in their consequences, the global award is reduced from the simple sum of the JCG bands. A 30% discount is common where two significant injuries materially overlap; deeper discounts apply where there is substantial overlap or where one injury dominates the long-term picture.
The dominant injury. Where one injury is significantly more serious than the others (for example, a brain injury that defines the long-term prognosis), the lesser injuries are absorbed into the overall assessment rather than added on top. The risk for the claimant is that lesser injuries get under-investigated when attention is focused on the dominant injury, and end up under-compensated.
Special damages, by contrast, are assessed cumulatively. Loss of earnings, care costs, rehabilitation, equipment and accommodation adaptations are calculated on the basis of the combined effect of all the injuries, not adjusted downwards.
Why you’ll see more than one medical specialist
Polytrauma claims usually require expert reports from several specialists working in parallel. A typical claim might involve:
- An orthopaedic surgeon for fractures and joint injuries
- A neurologist and a neuropsychologist for brain or head injuries
- A psychiatrist or psychologist for PTSD and mood-related sequelae
- A pain medicine consultant where chronic pain is a feature
- A care expert and a rehabilitation case manager to project future needs
These specialists often need to comment on each other’s findings. A neuropsychologist will need orthopaedic input to understand which symptoms are mechanical and which are cognitive. A pain consultant’s view of medication tolerance affects what the orthopaedic surgeon can recommend. Coordinating that evidence so it tells a coherent story is one of the main jobs of a specialist polytrauma solicitor.
Why lesser injuries get missed
When one injury is catastrophic, clinical and legal attention naturally concentrates on it. Lesser injuries, particularly those that are slow to declare themselves (tinnitus, anosmia, mild cognitive impairment, soft-tissue back pain), can be under-recorded in the early medical notes and harder to evidence later.
We see this regularly. A client with a serious leg injury and a head injury describes only the leg pain in the first weeks because the head injury has affected their insight. A client with severe orthopaedic injuries and tinnitus does not mention the tinnitus until after the orthopaedic surgery is done, by which time the connection to the original accident is harder to prove.

Recent multiple injury settlements
£380,000 for a pedestrian with TBI, sight loss and orthopaedic injuries
Siobhan McIvor, Partner in the personal injury team, settled a polytrauma claim for a pedestrian struck by a scooter. The claimant suffered a traumatic brain injury with ongoing cognitive impairment, the complete loss of sight in one eye and several orthopaedic injuries: three distinct injury systems requiring three separate streams of medical and rehabilitation evidence. After the insurer made progressively higher buy-off offers from £50,000 to £230,000, the case settled at a Settlement Meeting for £380,000, with substantial interim payments and insurer-funded rehabilitation secured during the claim. £150,000 for a pedestrian with TBI, shoulder dislocation and a knee injury
Eloise Mears acted for a young professional struck on a pedestrian crossing by an unsupervised learner driver. He sustained a traumatic brain injury, a dislocated shoulder and a soft-tissue knee injury, requiring 11 days as an inpatient. The coordinated rehabilitation needs (cognitive therapy, orthopaedic recovery and a phased return to work) were managed through a single Rehabilitation Case Manager funded by the defendant insurer. Settlement and timing
Polytrauma claims should not be settled until the long-term medical picture is clear. Premature settlement is the single most common cause of under-compensation in this area: an offer that looks reasonable two years after the accident may prove inadequate once cognitive symptoms, chronic pain or delayed orthopaedic complications declare themselves.
Most polytrauma claims take three to five years to settle, sometimes longer. Where the claimant has immediate financial difficulty, we apply for interim payments to fund accommodation, equipment, rehabilitation and lost income while the claim continues. Where liability is clear, interim payments can be substantial.
Catastrophic and serious cases
Some polytrauma claims meet the threshold for catastrophic injury handling. This is a higher level of resourcing, including a dedicated catastrophic injury solicitor, immediate access to a rehabilitation case manager, and early engagement with the defendant insurer’s major loss team. Where a client has lifetime care needs or has lost the ability to work permanently, the claim is structured to provide for those costs over the remainder of life expectancy, often through a combination of lump sum and periodical payments.

Frequently asked questions
Why don’t I just add up the JCG figures for each injury?
Because courts apply a discount when injuries overlap. The combined impact on your life is usually less than the sum of each injury considered alone, so the global award is reduced accordingly. Special damages (lost earnings, care, rehabilitation) are not discounted in the same way and are calculated on the cumulative effect of all the injuries.
How long does a multiple injury claim take?
Typically three to five years, longer in catastrophic cases. The driver is not the legal process but the medical one: settlement should wait until the long-term consequences of all the injuries are clear. Interim payments are available throughout to cover immediate financial needs.
What if a lesser injury was missed at the time?
We work with you and your treating clinicians to make sure the medical notes accurately record every injury and symptom. Where an injury was under-recorded at the time, we can usually reconstruct it from subsequent records, witness accounts and your own contemporaneous communications, though it is significantly easier when it is documented from the outset.
Will I need to see multiple medical experts?
Yes. In a typical polytrauma claim you can expect to attend appointments with several specialists over the life of the case, often including an orthopaedic surgeon, a neurologist, a neuropsychologist and a care expert. We organise the appointments and ensure each report is properly briefed.
