What is a head injury?
A head injury is any injury to the head, face or skull. Some injuries resolve within weeks, while others lead to persistent symptoms that affect daily life and the ability to work.

Time limits for head injury claims
In most cases, you have three years from the date of the accident to bring a head injury claim. There are important exceptions:
- If you lacked mental capacity following the injury, the three-year period does not start running until your capacity is recovered, or not at all if it is never recovered.
- For children, the three-year period runs from their 18th birthday — giving them until age 21 to bring a claim in their own name. A litigation friend (usually a parent or guardian) can bring the claim on their behalf at any point before that.
- For criminal injuries (assault), different time limits apply through the Criminal Injuries Compensation Authority.

Head injury compensation amounts
Compensation for a head injury is calculated based on two types of loss.
General damages cover pain, suffering and loss of amenity — the injury itself and its impact on your life. Awards are assessed by reference to the Judicial College Guidelines (JCG):
- Minor head injury (full or near-full recovery, no lasting effects): up to £13,740
- Less severe head injury (good recovery with some persisting symptoms, e.g. post-concussion syndrome, ongoing headaches): £13,740 – £52,550
- Moderate head injury (significant ongoing impairment affecting work and daily life): £52,550 – £150,110
- Moderately severe / severe head injury (serious and lasting impairment): £150,110 upwards
Special damages cover financial losses caused by the injury and are often the larger element in serious cases:
- Loss of earnings — past and future, including pension loss
- Treatment costs — physiotherapy, specialist review, medication
- Rehabilitation and therapy
- Care and support needs
- Travel expenses
- Future losses where symptoms are ongoing
