Accident During a College Class

Eloise Mears, Solicitor at Osbornes Law, represented a student who sustained a head injury while working in a college class. The accident occurred when a heavy bar became dislodged from the wall and fell directly onto her head. This unexpected incident left the young student with a head injury and ongoing neck pain, significantly impacting her daily life and studies.

Insurer accepts liability

After the incident, the student turned to Osbornes Law for help, and Eloise Mears quickly took on her case. Eloise acted swiftly to investigate the circumstances of the accident and was able to establish liability with the insurer for the responsible party. The insurer accepted fault and agreed to provide funding for the client’s medical rehabilitation, ensuring she received the necessary care without delay.

Rehabilitation

With the support of a Rehabilitation Case Manager, who was funded by the insurer, our client began a comprehensive recovery program. She underwent physiotherapy to treat her neck pain and address the physical effects of the accident, while also receiving psychological therapy to cope with the emotional trauma caused by the sudden injury. Additionally, the student saw a Consultant Neurologist privately to assess the extent of her head injury and receive specialised care.

Reports from several medical experts

As part of the legal process, Eloise obtained detailed medico-legal reports from several medical experts, including a Spinal Surgeon, a Neurologist, and a Psychiatrist. These reports provided critical insight into the severity of her injuries and the long-term impact they might have. Fortunately, the experts concluded that the student had a good prognosis, with a high likelihood of recovery after further treatment.

Settlement of £75k

Given the extent of the injuries and the need for continued treatment, Eloise Mears successfully negotiated a financial settlement of £75,000. This substantial compensation not only accounted for the physical and psychological harm the student had suffered but also ensured that she would have access to future private treatment to aid her continued recovery. The financial award allowed our client to focus on her health without worrying about the costs associated with ongoing medical care.

Eloise Mears’ Comments

Eloise reflected on the importance of this case and her client’s successful recovery: “My client was going about her day at college when, very unexpectedly, she suffered a head injury from a falling object. The medical reports we obtained reassured her that with further treatment, the effects of the injury would likely reduce in time. I am so pleased that we were able to negotiate a financial award for her that means she can continue to receive treatment and improve. Seeing her progress has been incredibly rewarding, and we are proud to have helped her on this journey.”
