Compensation After Accident at Work Leads to Blood Clot

Serious injury lawyer, Blanca Diego Casas recently represented an individual who suffered serious medical complications after sustaining an injury at work.

Blanca’s client was at work when two heavy doors fell on his ankle and left heel.

Although our client was wearing safety boots, the weight of the doors meant that he still sustained an injury to his ankle. This injury led to our client’s ankle being placed in a backslab plaster of Paris cast for over six weeks.

During this time our client was not permitted to take his medication, thromboprophylaxis, that works to prevent the development of blood clots. Because of this, along with the long period of immobility from the ankle fracture, our client suffered a bilateral segmental and subsegmental pulmonary embolism three months later.

After a number of months, the provoked thrombus and the clot had resolved, and our client was then advised to take anticoagulants to prevent future clots.

To establish the link between the injury at work and the pulmonary embolism, Blanca instructed third party medical experts who concluded that the pulmonary embolism would not have developed in the absence of the accident.

Blanca also obtained a report from a Consultant Haematologist and this expert confirmed that our client would be considered at high risk of venous thromboembolism (VTE) at the time of future periods of immobilisation.

“The injury my client suffered led to a potential life-threatening situation when he developed a blood clot. Thankfully this was not the case, however, with the assistance of our medical experts, we were able to establish that this condition was as a result of the injury at work. My client took all the necessary PPE precautions and was still injured. We dread to imagine what would have occurred if he did not have the correct footwear on.”

The Defendant’s insurer proved to be helpful and admitted liability quite early on in the case. A case manager was then instructed on a joint basis and the Claimant’s needs were rightfully highlighted.

The case finally settled for over £75,000. This included both compensation for our client, and the benefits that the Defendant repaid to the DWP (Department for Work and Pensions)
