High-value brain injury settlements
The most serious brain injuries need compensation that covers a lifetime of care, lost earnings and adapted living. These are some of the largest results our serious injury team has secured.
£12 million for a pedestrian left with a hypoxic brain injury
Our client was run over as a pedestrian in Essex and suffered a hypoxic brain injury, which is brain damage caused by a loss of oxygen. He was left blind and reliant on a wheelchair, and he needs nursing care for the rest of his life. Read the £12 million brain injury case study.
£7.2 million after a hit-and-run brain injury
A speeding driver ran our client over in Croydon and fled the scene. The driver was later traced, convicted and jailed. The settlement includes periodical payments, which are guaranteed payments made every year for life to fund ongoing care. Read the £7.2 million hit-and-run case study.
£2.35 million for a pilot whose career ended after a head injury
An airline pilot suffered a brain injury when a sign fell on his head at a London tube station. The injury cost him his licence and his flying career. We secured £2.35 million to reflect his lost earnings and future needs. Read the falling tube sign case study.
£1 million for a subtle brain injury that ended a legal career
Our client was a legal costs draftsman left with a subtle brain injury. He could no longer continue in his personal injury firm, so the claim covered his lost earnings and his lost equity share in the business. It settled for £1 million after detailed valuation of the business.
Brain injuries caused by road accidents
Road accidents are a common cause of serious head and brain injury. These claims often involve disputed liability, so strong evidence matters.
£454,000 after a drunk driver ran over our client’s head
Our client suffered serious brain and facial injuries when a vehicle driven by a drunk driver ran over her head. The motor insurer disputed whether it had to pay out at all. We secured £454,000 in full and final settlement.
£250,000 for a train driver with a mild traumatic brain injury
A 58-year-old train driver suffered a mild traumatic brain injury in a moped accident. He had to retire early because of fatigue and concentration problems, and he recovered a £250,000 lump sum despite some unrelated health issues.
Compensation and rehabilitation for a passenger’s brain injury
Our client suffered a serious head and brain injury, along with a fractured neck and pelvis, as a passenger in a car accident. He was not wearing a seatbelt, so the insurer argued he was partly to blame. We reduced the proposed contributory negligence deduction to 15% and secured funds for long-term rehabilitation and case management.
Liability secured for a child pedestrian with a brain injury
A child was knocked over by a car while crossing the road and suffered a traumatic brain injury and serious orthopaedic injuries. Using accident reconstruction evidence, we secured liability at two-thirds in the child’s favour, approved by the High Court, with the value of the claim to follow.
Brain injuries at work and in public places
Employers and occupiers have a duty to keep people safe. When they fail, the results can be life-changing.
£103,000 for an estate agent left with cognitive problems
Our client, an estate agent, fell through an unguarded hole in a floor while showing a flat. He made a good recovery and went on to gain an MBA, but he was left with subtle cognitive problems. The claim settled for £103,000 despite a denial of liability.
£101,523 through the criminal injuries scheme after an assault
A man was assaulted with a baseball bat and suffered a brain haemorrhage and a skull fracture. We brought a claim through the Criminal Injuries Compensation Authority (CICA), the government scheme for victims of violent crime. The £101,523 award covered lifelong care from his family, and we set up a personal injury trust to protect his benefits.
A rehabilitation package for a passenger hurt on a boat
Our client was struck on the head by the metal railings of a yacht when the boat she was travelling on came too close. Liability was admitted early, so we put a rehabilitation package and a case manager in place quickly to support her recovery.
How brain injury compensation is calculated
Brain injury compensation has two parts. General damages cover the injury itself, the pain and the effect on your life. Special damages cover financial losses such as care, lost earnings, equipment and adapted accommodation, often over a lifetime.
In the most serious cases, part of the award is paid as periodical payments rather than a single lump sum, so the cost of care is guaranteed for life. For more detail on how claims work, see our brain injury compensation page.
