The elbow is one of the most complex and utilised joints in the body. It allows you to do many things that you probably take for granted, from throwing a ball and carrying your shopping bags to simply holding your children. You can do all of this because the elbow makes it possible to bend, straighten or rotate your arm.

However, this means that when something goes wrong, the injury can be debilitating. People with an elbow injury such as a sprain, dislocation or tennis elbow are often unable to work for a period, and may struggle with everyday activities such as dressing, preparing food and driving. Injuries that happen today can cause pain and inconvenience for years to come.

If you have experienced an elbow injury caused by the negligence of another party, the empathetic elbow injury specialists at Osbornes Law can help you claim compensation.

Most elbow injury claims can be settled on a no win, no fee basis, which means there’s no financial risk to you.

What types of elbow injuries can you claim for?

The elbow connects the three arm bones and is a surprisingly complex joint. Common injuries include:

Elbow dislocations

It is human instinct to put your arms out when falling and this type of impact is a leading cause of elbow dislocation. While most elbow dislocations can be returned to their original alignment, an injury may result in nerve damage or restricted blood flow if it is not treated promptly.

Elbow fractures

Fractures can occur in any of the arm bones but they are most commonly found in the knobby end of the radius bone where it meets your elbow. Serious radial head fractures may require surgery and extensive physiotherapy to restore the palm up/ palm down rotation of the hand.

Strains and tears

Strains and tears to a tendon, ligament or muscle can be mild, causing only temporary discomfort, or they may need surgical intervention to repair the tear. Strapping or bracing the joint may also be recommended, which can further restrict movement.

Tennis elbow and golfer’s elbow

Tennis elbow is a condition that causes pain on the outside of the elbow due to repetitive stress on the forearm muscles. Golfer’s elbow causes pain on the inside of the elbow and is usually a result of the wrist flexors being overused. Injuries can take two years or longer to heal and may require steroid injections and therapy to ease the pain and restore grip strength.

Bursitis

Bursitis is an inflammation of the small fluid-filled sacs that act as cushions between bones and soft tissues. The most common cause of elbow bursitis is prolonged pressure or friction on the elbow, such as leaning on a hard surface for extended periods.

Amputations

High-trauma incidents like a car crash can result in partial amputation of the arm at the elbow. Doctors may also recommend amputation to halt the progression of an infection and preserve the rest of the arm. Amputations are serious life-changing injuries. They require extensive physical and psychological rehabilitation and receive some of the highest compensation payouts as a result. Find out more from our amputation claim lawyers.

What are the common causes of elbow injuries?

Elbow injuries are classified as trauma or overuse. Trauma injuries are sudden and the result of a high force on the joint, while overuse injuries occur as a result of repetitive stress on the elbow. Some common causes of elbow injuries include:

Slips, trips and falls

Falls are a common cause of elbow fractures and dislocations and you do not need to fall very far to suffer an elbow injury. Everyday slips and trips can hurt the elbow joint if you land on an outstretched arm with force.

Most trip and fall accidents occur on slippery or poorly maintained surfaces. Businesses and public organisations have a legal responsibility to keep their premises safe for visitors and employees. If they fail in this duty, they may be liable to pay compensation.

Accidents at work

Whether it’s falling off a ladderoperating vibrating machinery or hurting your elbow while carrying heavy items in a warehouse, the workplace is full of elbow injury hazards.

Employers have a duty to keep their employees safe while at work and must carry out risk assessments to identify and manage the risk of elbow injuries. If your employer fails to provide appropriate equipment, training, work schedules or rest periods, you may be able to make a claim for compensation.

Road accidents

The force of a car accident can easily cause the elbow to sprain, break or dislocate, whether you are a driver, passengercyclist or pedestrian. Even low-speed collisions can cause significant damage depending on the angle at which impact occurs.

Cyclists are particularly vulnerable. They face a range of obstacles that potentially could throw them off their bikes, from potholes in the road to careless drivers who “car door.”

Road users owe each other a duty of care to use the roads responsibly and minimise the risk of an accident occurring. If they act negligently and cause an accident, they may be liable to pay compensation.

Sports injury

You don’t have to play tennis to experience a sports-related elbow injury. Body checks and falls in contact sports like football and rugby can result in trauma to the elbow, and the gym equipment you use to stay fit can put undue strain on the elbows if it is not used properly.

There are many possible causes of a sports injury. Faulty equipment, poorly maintained playing fields, reckless tackles and poor advice by a trainer can all potentially lead to a compensation claim, if someone else is at fault.

Medical negligence

Negligence by healthcare professionals can lead to an elbow injury or cause an existing elbow injury to become worse. Examples include the missed diagnosis of an elbow fractureerrors made during surgery, or failure to identify and treat an infection.

If the quality of medical care was substandard and it caused or aggravated an elbow injury, you may be entitled to compensation.

Am I eligible to make an elbow injury claim?

Generally, you will be eligible to make an elbow injury compensation claim if:

  • Someone had a duty of care towards you
  • They breached that duty of care by acting negligently
  • Their negligence led to the incident that caused your injuries
  • The incident took place in the last three years

The easiest way to determine if you can make an elbow injury claim is by contacting a personal injury solicitor. They will listen to your account of the incident and advise you on whether you have a valid claim for compensation, and who the claim would be against.

How much can I claim for an elbow injury?

Compensation is made up of two parts:

  1. Compensation for the physical and emotional pain and suffering. The exact amount you could receive depends on multiple factors including injury type, duration of pain, treatments needed, work impact, quality of life and future deterioration and effects of the condition.
  2. The financial losses you have incurred. This might include:
  • Medical expenses such as steroid injections, scans and hospital stays
  • Physiotherapy and other treatments
  • Medical equipment such as braces, straps, walking aids and prosthetics
  • Travel costs
  • Care costs
  • Lost wages
  • Loss of future income, for example, if you have to take a lower-paid job because of your elbow injury

What are the average payouts for elbow injury claims?

First and foremost, a medical examination will be able to determine how bad the elbow injury is and how it might affect your life in the future. If

Once your solicitor has the medical report, they will consult the Judicial College Guidelines. This is what a judge would use to put a value on the “pain and suffering” aspect of your elbow injury claim if the case came before them. The guidelines cover a wide selection of injuries and ascribe a value depending on the diagnosis.

In the case of elbow injuries, these are the currently recommended compensation payouts:

  • Up to £12,590 for minor elbow injuries such as a simple dislocation or fracture where there are no long-term problems.
  • £15,650 to £32,010 for moderate elbow injuries such as fractures that leave you with longer-term restriction of movement, but do not cause permanent disability.
  • £39,170 to £54,830 for a severe elbow injury that needs surgery and causes long-term disabling problems.
  • £96,160 to £109,650 for the loss of one arm at the elbow.

Are there time limits for making an elbow injury claim?

Yes, the statute of limitations for an elbow injury claim is three years from the date of the accident in most cases.

Overuse injuries like tennis elbow develop over time and do not have a clear date of onset. In these cases, the three-year time limit will start from the date you receive a diagnosis and become aware that your injury was caused by someone else’s negligence.

If you are beyond this time limit, speak with a solicitor as there sometimes can be exceptions to this.
