The shoulders are essential to our ability to interact with the world. The pain and disability caused by a shoulder injury can hamper routine activities such as driving, cooking, personal grooming, laundry and dressing. Recovery usually involves a course of treatment, physiotherapy and even surgery for severe injuries. You may worry about taking time off work, adding financial stress to an already challenging situation.

If you have sustained a shoulder injury as a result of a workplace accident, a road accident, an accident at a public venue, medical negligence or any other kind of accident, we are here to help you claim compensation. It’s important to explore your legal options, so you can access the compensation you deserve and focus on your recovery.
In this article, we’ll explore shoulder injury compensation payouts and how they’re determined. Understanding the factors that influence these payouts can help you understand the scale of the claims process more effectively if you’ve suffered a shoulder injury due to someone else’s negligence.
The four shoulder injuries we see most often in claims
Shoulder injury claims usually fall into one of four clinical categories, and the type of injury you have affects both how it is evidenced and what your claim is worth.
Rotator cuff tears. The rotator cuff is the group of four tendons that hold the shoulder joint in place and let you lift and rotate your arm. Partial tears often happen gradually through overhead work, with electricians, painters, sewage workers and warehouse pickers being common claimants. Complete tears more often come from a sudden trauma like a cycling fall or being struck by a vehicle as a pedestrian. Evidence usually involves an MRI scan, and surgical repair is common.
Dislocations and AC joint injuries. Anterior shoulder dislocations are the most frequent, typically from a fall onto an outstretched arm in cycling collisions or rugby tackles. AC (acromioclavicular) joint sprains and separations happen in similar mechanisms but recover faster. Both can leave permanent instability if not treated quickly.
Fractures of the clavicle, scapula or proximal humerus. Broken collarbones are the classic cycling injury, frequently requiring surgical fixation with a plate and screws. Scapular fractures are rarer and usually point to a high-energy mechanism such as a motorcycle crash or fall from height, often alongside rib or chest injuries. Proximal humerus fractures are more common in older claimants from low-energy falls and can complicate into avascular necrosis.
Frozen shoulder (adhesive capsulitis) and impingement. Often the secondary consequence of a different shoulder injury or surgery. The disabling phase can last 18 to 24 months and significantly affects loss-of-earnings claims even where the initial injury was modest.
What this means for your claim value
The Judicial College Guidelines, 18th edition (November 2025), place shoulder injuries in these bands:
- Soft tissue injury, full recovery within 3 months: up to £3,240
- Soft tissue injury, full recovery within a year: £3,240 to £5,750
- Soft tissue injury, full recovery within 2 years: £5,750 to £10,420
- Moderate (frozen shoulder, soft tissue with persistent symptoms): £10,420 to £16,870
- Clavicle fracture: £6,800 to £16,170
- Serious (dislocation with limitation of arm movement, persistent neurological symptoms): £16,870 to £25,370
- Severe (significant disability, may include brachial plexus involvement): £25,370 to £63,450
Special damages (earnings, care costs, private surgery, future treatment) usually exceed general damages once a claim is serious.
The single most useful thing you can do early is get the diagnosis recorded properly. A consultant orthopaedic letter that names the injury (rotator cuff supraspinatus tear, Bankart lesion, Neer-type proximal humerus fracture) is the foundation of every well-evidenced shoulder claim.
Can I claim for earnings I lost as a result of my shoulder injury?
In addition to compensation for the pain and suffering of a shoulder injury, you can claim for your financial losses and expenses. This includes:
- Medical treatment and prescription costs, such as private tests, X-rays, corticosteroid injections and physiotherapy
- Travel expenses to attend medical appointments
- Cost of care and support
- Loss of earnings due to time off work
- Future loss of income based on your ability to return to work and expected earning capacity in the future.
Your solicitor will refer to the medical report to determine how long you need to recover and when you might be able to go back to work. This helps them calculate a fair amount of compensation for the losses your shoulder injury has caused you and may continue to cause you in the future.
Am I eligible to make a shoulder injury claim?
You are eligible to make a shoulder injury compensation claim if:
- Your shoulder was harmed in the last three years,
- Due to someone else’s negligence, and
- That person or organisation owed you a duty of care.
A duty of care means someone has legal responsibility to avoid causing harm to another. For instance, employers owe a duty of care to provide a safe working environment for their employees. Drivers have a duty of care to operate their vehicles responsibly and safely. Product manufacturers have a duty of care to produce and distribute safe products for consumers.
These are just examples, and the specifics of your situation will dictate who has a duty of care towards you and who the claim should be made against. Your solicitor will be able to advise you on whether you are eligible to make a claim.
Is there a time limit for making a shoulder injury claim?
In most cases, you have three years from the date of your accident to make a claim.
For shoulder injuries that occur slowly over time, the three-year timeline starts from the date you learned about your injury and realised that it could be due to someone else’s negligence.
Three years may seem like a long time but the sooner you start your claim, the better. Your claim may be stronger when evidence and testimonies are fresh, so speak to us early so we can advise you.

“The service and results I received from Robert Aylott and the team at Osbornes was exceptional. Experts in their field and total professionals from start to finish. In 2018 I was involved in a serious motorcycle accident and required surgery the other party denied liability and there were few witnesses. After an initial interview Robert assessed my case and advised they were confident in securing me substantial losses. This they did in a reasonably short timescale securing me a six figure sum well above my initial hopes. If you are unlucky enough to be involved in an accident I recommend this team fantastic 5* Professionals.”
“Literally, putting your future in their hands, Robert Aylott and the team at Osbornes Law took the uncertainty, vulnerability and fear resulting from a catastrophic life event and turned it into a safety net for the rest of my life. Empathy, professionalism and delivering exactly what they say. You’re safe in their hands”.
