Unfortunately, the medical expert advised that the motorcyclist had an abnormality of the mid-calf and 3 years on from the accident, he still had pain with activity, including prolonged standing and swelling of the left leg. He further suffered from pain when standing on ladders, a large part of his employment, when riding a bike and walking his dog. It was subsequently concluded that it was unlikely the motorcyclist’s function would improve beyond this current state for the foreseeable future and was unfortunately permanent.

Court proceedings were issued and the motorcyclist’s claim subsequently settled upon the acceptance of the Defendant’s insurer’s offer of £40,000. This settlement included not only a portion for his injuries but also for his financial losses to include loss of earnings, damaged property, medical expenses and future loss of earnings capacity.
