The hip joint is a ball and socket joint that connects the thigh bone to the pelvis. It is an essential weight-bearing part of the body, enabling us to walk, run, lift, twist and carry out daily activities.
Injuries in this area can be extremely painful and debilitating. They often require extensive medical intervention and long periods of rehabilitation, and usually impact your ability to move freely.
In some cases, surgery is necessary to repair the hip or replace it with an artificial joint. Patients may need to be on crutches or in a wheelchair while the injury heals, and there may be an increased risk of developing osteoarthritis in the future.
If you have been affected by a hip injury, we can help you claim compensation.
What qualifies as a hip injury?
Any damage to the hip socket or pelvic bone can be considered a hip injury. It’s a broad spectrum that includes:
Fractures: Fractures in the hip or pelvis often occur due to high-impact trauma such as a car accident or af all from a ladder. Depending on the severity, fractures can take many months to heal and may require surgery and ongoing therapy.
Dislocations: A hip dislocation occurs when the femur slips out of its socket, causing extreme pain and immobility. A dislocated hip can also cause widespread loss of feeling in the foot or ankle area due to nerve damage. This type of injury is common in high-impact sports accidents or car accidents.
Strains and sprains: When the muscles or ligaments around the hip are stretched beyond their capacity, it can cause strain or sprain injuries. These types of injuries can occur during physical activities or repetitive motions.
Bursitis: Bursae are small fluid-filled sacs that provide cushioning between bones and soft tissues like muscles and tendons. There are two major bursae in the hip, and injuries can cause inflammation and significant pain in the hip area.
Arthritis: Chronic and degenerative conditions like arthritis can cause inflammation and breakdown of the hip joint, leading to severe pain and stiffness. If you have developed arthritis following an accident, or due to poor working practices on you job, you may be entitled to compensation.
What causes hip injuries?
Hip injuries are often associated with road accidents. Pedestrians, cyclists, motorcyclists and passengers, as well as car drivers, are vulnerable to hip injuries as the force of impact from a car can easily force bones out of the hip socket.
Fast-paced and high-impact sports such as football and rugby can also cause trauma to the hips.
Does your job involve heavy lifting and carrying? Over time, the type of movement associated with warehouse loading can put stress on the hip joint. Your hip injury could also be the result of a traumatic accident at work, such as a fall from a ladder. If you are not provided with the correct safety equipment, lifting aids, rest breaks or training, you could make a hip injury claim against your employer.
Among the elderly, slips, trips and falls are the leading cause of hip injuries. About one-third of the senior population falls each year and the risk of sustaining a hip fracture increases with age.
In some cases, medical negligence during surgery or childbirth may lead to hip injuries.
Since hip injuries can happen in a number of ways, identifying what type of injury you have sustained and how serious the injury is will be vital when making a compensation claim. Your financial settlement will largely depend on how much long-term disability and discomfort your injury has caused and its impact on your life.
How much compensation can I claim for a hip injury?
We cannot say exactly how much compensation you will receive for your hip injury as it depends on the specific details of your case. However, we can provide a rough estimate.
The following amounts are based on figures provided by the Judicial College Guidelines. The Guidelines are a set of compensation tables which are used by courts to determine compensation amounts:
- Minor soft tissue injuries that heal in a few months – up to £3,590
- Minor hip injury that leads to minor ongoing pain but no permanent disability – £3,950 to £12,590
- Moderate hip injury requiring surgery or a hip replacement – £12,590 to £39,170
- Serious hip injury causing degeneration to the joint and problems walking – £39,170 to £52,500
- Very serious hip injury involving multiple fractures and significant disability – £61,910 to £130,930
These figures are for the injury alone and do not include financial losses due to inability to work or additional expenses caused by the injury. Out-of-pocket expenses such as lost wages, medical bills, travel costs, ongoing therapy, walking aids and home adaptations can be added to the value of your claim.
If you have to take a lot of time off work or your injury reduces your ability to work in the future, then loss of earnings and anticipated loss of future earnings could form the major part of your settlement amount.
Can I claim for the psychological impacts of a hip injury?
Yes, you can claim compensation for psychological impacts of a hip injury. In fact, it is common to experience distress due to mobility limitations and chronic pain. Fear of falling can also lead to anxiety and social isolation, especially among older people.
Our legal team will consider the mental health impacts as well as the physical injury when negotiating your compensation claim. We may arrange for you to see a mental health professional if required, and their report will form part of the evidence in your claim.
How long do I have to make a hip injury compensation claim?
The statute of limitations for personal injury claims is three years. This means you have three years from the date of your accident to make a claim.
However, there are exceptions:
- If you were under 18 at the time of the accident, you have until your 21st birthday to make a claim.
- If you were mentally incapable of making a claim at the time of the accident, there is no time limit for making a claim.
- If your condition has come on slowly over time, the time limit will start from the date of your diagnosis.
Three years may seem like a long time, but it’s essential to seek legal advice as soon as possible. The earlier you start your claim process, the better your chances of receiving full and fair compensation for your hip injury.
How do I make a claim for a hip injury?
If you have decided to make a hip injury claim and have given a solicitor the go-ahead, these are the key stages that your solicitor will follow:
- Investigate your claim to work out what happened and who was responsible. This isn’t always clear. For example, it can be difficult to prove that your employer was responsible for bursitis if you had pre-existing hip problems.
- Gather evidence to support your claim. Evidence can take many forms, including police reports, photos, CCTV footage, witness statements, medical reports and financial records.
- Assess your injuries. If you have already received medical attention, your solicitor will review your medical records. They will also arrange for you to be examined by an independent medical specialist who will assess the nature and extent of your injuries and consult with specialists where necessary.
- Calculate the amount of compensation you are eligible to receive. Your solicitor will use their experience in personal injury claims, as well as references such as the Judicial College Guidelines and past cases, to estimate a fair amount of compensation. The calculation will include expenses and loss of earnings, both past and future.
- Negotiate a settlement with the party responsible for your injuries. The majority of hip injury claims are settled out of court, and there may be some back-and-forth as your solicitor negotiates a figure that’s acceptable to everyone.
- Court action. If no agreement can be reached, your solicitor may recommend taking the case to court. If this happens, it’s up to the court to determine how much compensation you receive.
