If you’ve been injured in an accident involving an Uber – whether as a passenger, another car driver, cyclist, motorcyclist or pedestrian – you may be entitled to compensation. Uber accident claims can be more complicated than standard taxi accident claims because they involve insurance cover that is specific to rideshare drivers and there can be questions over who is legally responsible.

Who can claim for uber accidents?
Injured pedestrians, cyclists and other road users
If you were injured in an accident as a cyclist, pedestrian or the driver or passenger of another vehicle, you may be able to make a claim for compensation.
As with all road traffic incidents, your solicitor will need to show that the Uber driver was at fault and that your injury was a direct result of their negligence. Uber drivers must observe the rules of the road like any other vehicle. This includes driving at an appropriate speed and following the provisions of the Highway Code.
If the driver failed to adhere to these rules and caused your accident, you may have a strong case for compensation.
Passengers injured in the Uber
If you were injured whilst travelling in an Uber, you could be eligible to claim compensation. Examples include:
- The driver was texting, resulting in an accident.
- The driver set off before you had fully exited the car.
- The driver braked sharply, causing you to fall out of your seat.
- The driver was paying more attention to their GPS than the road, resulting in a collision.
The claim will be different depending on who caused the accident. If another driver is at fault, then your claim would be made against the other driver’s insurance.
If the driver of the taxi is at fault, then you would pursue a claim against the driver and/or the taxi firm that they work for. Taxi drivers are responsible for their passenger’s safety and must take reasonable care to prevent accidents from happening. If they fail to do so and cause an injury, you may have grounds for a compensation claim.

2. Gathering evidence
To build a strong case, we may obtain police reports and witness statements, access Uber’s trip records and driver information, gather medical records and expert reports, secure CCTV or dashcam footage of the incident, and investigate road conditions and vehicle maintenance history.
3. Establishing liability
Responsibility can vary depending on whether the Uber driver’s app was:
- On-Trip and carrying a passenger or en route to a pick-up – Uber’s highest level of cover applies
- On-Trip and waiting for a ride request – lower cover applies
- Off-Trip – only the driver’s personal insurance applies
Other liable parties may include another motorist, a local authority (for poor road conditions) or, in rare cases, a vehicle manufacturer.
How much compensation could I get for an Uber accident?
There is no set amount of compensation for an Uber accident. Each claim is unique and depends on the specific circumstances of the accident and resulting injuries. Your solicitor will consider several factors when determining the value of your claim, including:
- The type injuries and how serious they are
- How long it will take you to recover
- Medical treatment and rehabilitation costs e.g. physiotherapy
- The cost of vehicle repairs
- The value of your vehicle if it has been written-off
