Uber accident claims lawyers

If you’ve been injured in an accident involving an Uber – whether as a passenger, another car driver, cyclist, motorcyclist or pedestrian – you may be entitled to compensation. Uber accident claims can be more complicated than standard taxi accident claims because they involve insurance cover that is specific to rideshare drivers and there can be questions over who is legally responsible.

At Osbornes Law, our specialist personal injury solicitors have the experience and knowledge to guide you through the process of making a claim. We will guide you through the process and work to secure the best possible outcome for your case.

Why Uber accident claims are different

Uber accidents can raise unique issues. Responsibility for your injuries may depend on the driver’s status at the time of the accident, whether other road users were involved, and which insurance policy applies.

Our team is experienced in:

  • Understanding Uber’s UK insurance structure and how cover changes during a journey
  • Investigating complex liability issues involving multiple parties
  • Accessing critical evidence such as Uber trip data and driver information
  • Negotiating with large insurance companies

In some cases, questions around employment status and liability have been shaped by rulings such as Aslam v Uber BV [2021] UKSC 5, which confirmed that Uber drivers can be classified as workers under UK law. This case has influenced how responsibility is viewed in accident claims involving rideshare drivers.

Who can claim for uber accidents?

Injured pedestrians, cyclists and other road users

If you were injured in an accident as a cyclist, pedestrian or the driver or passenger of another vehicle, you may be able to make a claim for compensation.

As with all road traffic incidents, your solicitor will need to show that the Uber driver was at fault and that your injury was a direct result of their negligence. Uber drivers must observe the rules of the road like any other vehicle. This includes driving at an appropriate speed and following the provisions of the Highway Code.

If the driver failed to adhere to these rules and caused your accident, you may have a strong case for compensation.

Passengers injured in the Uber

If you were injured whilst travelling in an Uber, you could be eligible to claim compensation. Examples include:

  • The driver was texting, resulting in an accident.
  • The driver set off before you had fully exited the car.
  • The driver braked sharply, causing you to fall out of your seat.
  • The driver was paying more attention to their GPS than the road, resulting in a collision.

The claim will be different depending on who caused the accident. If another driver is at fault, then your claim would be made against the other driver’s insurance.

If the driver of the taxi is at fault, then you would pursue a claim against the driver and/or the taxi firm that they work for. Taxi drivers are responsible for their passenger’s safety and must take reasonable care to prevent accidents from happening. If they fail to do so and cause an injury, you may have grounds for a compensation claim.

Your solicitor will review the circumstances of the accident and determine who is liable for your injuries and who you should make the claim against.

Our Uber accident claims process

  1. Initial consultation to assess your claim

In our initial consultation we will review how the accident happened, identify who may be liable, assess your injuries and how they affect your life, check the available insurance cover, and explain our “no win, no fee” funding.

2. Gathering evidence

To build a strong case, we may obtain police reports and witness statements, access Uber’s trip records and driver information, gather medical records and expert reports, secure CCTV or dashcam footage of the incident, and investigate road conditions and vehicle maintenance history.

3. Establishing liability

Responsibility can vary depending on whether the Uber driver’s app was:

  • On-Trip and carrying a passenger or en route to a pick-up – Uber’s highest level of cover applies
  • On-Trip and waiting for a ride request – lower cover applies
  • Off-Trip  – only the driver’s personal insurance applies

Other liable parties may include another motorist, a local authority (for poor road conditions) or, in rare cases, a vehicle manufacturer.

How much compensation could I get for an Uber accident?

There is no set amount of compensation for an Uber accident. Each claim is unique and depends on the specific circumstances of the accident and resulting injuries. Your solicitor will consider several factors when determining the value of your claim, including:

  • The type injuries and how serious they are
  • How long it will take you to recover
  • Medical treatment and rehabilitation costs e.g. physiotherapy
  • The cost of vehicle repairs
  • The value of your vehicle if it has been written-off
  • Loss of earnings
  • Future financial losses, such as ongoing medical treatment or loss of future earning potential
  • Other expenses, such as transportation costs or car adaptations if they are needed to help you remain mobile

A good solicitor with experience in Uber accident claims will value your claim accurately and ensure you receive all the compensation you’re entitled to.

As part of this process, you may be asked to attend an independent medical assessment. The medical specialist will examine your injuries and give their opinion on how long it will take you to recover and how long you may be unable to work. Their report will be used as evidence in your claim and help determine the compensation amount.

Will I have to go to court?

Most Uber accident claims are settled without going to court. Our solicitors prepare strong evidence to support your claim and challenge any low offers. If necessary, we are experienced in taking claims to trial and will:

  • Meet all deadlines under the Limitation Act
  • Guide you through each stage of the process
  • Present complex liability issues clearly to the judge
  • Protect your interests from start to finish

Is there a time limit for making a Uber accident claim?

The sooner you instruct a solicitor, the better. In most cases, you have up to three years from the date of the accident to make any personal injury claim. However, it’s always best to begin the process as soon as possible while evidence is still fresh and witnesses can be easily contacted.

Accidents involving children and vulnerable people who do not have the capacity to manage their own affairs are subject to different time limits. A solicitor can advise you on the specific time limit for your claim.

Recent client story

One recent case involved jewellery designer, who was seriously injured when an Uber driver turned across his path while he was cycling home. The crash left him with a fractured hand, internal bleeding and unable to work for several months, causing significant loss of earnings. We secured an admission of liability from the driver’s insurers and won compensation for the impact the accident has had on his life. Read more here.
