Hugh Johnson, șeful departamentului de neglijență medicală la Osbornes Law, a obținut o despăgubire de mai multe milioane de lire sterline pentru Rose, o fostă asistentă socială pensionată în vârstă de 63 de ani, după ce spitalul local nu a reușit să diagnosticheze fracturi grave ale coloanei vertebrale, ceea ce a lăsat-o paralizată.
Context
În septembrie 2021, Rose a căzut pe o scară. Deși căzuse destul de puternic, ea a crezut inițial că a evitat o accidentare gravă.
Totuși, starea ei nu s-a îmbunătățit, astfel că a solicitat îngrijiri medicale. Aproximativ două zile după cădere, i s-a făcut un CT al întregii coloane vertebrale, care a fost interpretat ca fiind normal.
În zilele următoare, Rose și-a pierdut capacitatea de a merge și a devenit complet paraplegică. Ulterior a fost supusă unei operații la coloană, însă nu a înregistrat nicio îmbunătățire fizică. Chirurgul care o trata i-a recomandat să solicite consultanță juridică.
Dovezi ale experților
În momentul în care Hugh Johnson a fost implicat în caz, Rose fusese deja externată dintr-un centru specializat de reabilitare și se întorsese acasă, într-o locuință nepotrivită pentru nevoile ei.
Rose locuia într-o casă veche, care nu putea fi adaptată pentru situația ei: mai multe camere erau prea mici pentru un scaun cu rotile,nu avea acces la etaj și nu putea ajunge la baie.
Era evident că avea nevoie urgentă de o plată intermediară a despăgubirilor.
Hugh a angajat un radiolog pentru a reanaliza scanările inițiale. Acesta a descoperit că cinci fracturi separate fuseseră ratate.
Ulterior a fost obținută și opinia unui expert neurochirurg. Acesta a confirmat că, dacă scanarea ar fi fost interpretată corect și fracturile multiple ar fi fost identificate, tratamentul lui Rose ar fi fost diferit.
Ea ar fi fost operată înainte de a-și pierde capacitatea de a merge și ar fi avut o recuperare completă.
Sprijinirea reabilitării lui Rose
Pe parcursul procesului, Hugh a obținut £700.000 ca plăți intermediare de despăgubire.
Acest lucru i-a permis lui Rose, să înceapă fizioterapie specializată, să primească sprijin psihologic și să beneficieze de mai multe ore de îngrijire decât putea oferi NHS în comunitate.
De asemenea, a fost angajată o echipă specializată în găsirea de locuințe pentru a identifica o proprietate potrivită, pe care Rose să o poată închiria și adapta la nevoile sale medicale.
Despăgubirea estimată: £6,2 milioane
În martie 2025, echipele reclamantei și ale pârâtului s-au întâlnit pentru a negocia termenii despăgubirii, cu puțin timp înainte de proces.
S-a ajuns la un acord ca despăgubirea lui Rose să fie plătită parțial sub formă de plăți periodice. Acest lucru înseamnă că ea va putea acoperi costurile îngrijirii pentru tot restul vieții.
Valoarea totală capitalizată a despăgubirii este estimată la aproximativ 6,2 milioane de lire sterline.
Rose va continua să locuiască pe termen lung în locuința închiriată, atâta timp cât își poate permite echipa de îngrijire pe care o preferă.
Recent, ea a achiziționat și un vehicul adaptat pentru scaun cu rotile.
Un manager de caz a coordonat toate aranjamentele privind îngrijirea și locuința, astfel încât, în august 2025, Rose să poată pleca în prima ei vacanță de la accident.
