Osbornes obține o compensație de șase cifre în urma unei reclamații judiciare pentru o cezariană efectuată cu neglijență.
Jodi Newton, Partener și lider al echipei specializate în leziuni obstetricale și leziuni la naștere, a fost desemnată în cadrul unei revendicări pentru vătămare chirurgicală împotriva Frimley Health NHS Foundation Trust („Trust‑ul NHS”), unde vezica clientei noastre a fost perforată în timpul unei cezariene, iar Trust‑ul nu a investigat leziunea după operație.
Contextul cazului
Pacienta suferise două cezariene anterioare. Mai avea un istoric de colită ulcerativă, tratată cu infliximab și Asacol. În timpul celei de‑a treia sarcini, a fost programată o cezariană electivă, în cursul căreia vezica ei a fost perforată.
Perforarea vezicii este un risc cunoscut în chirurgia cezariană, în special când există adeziuni din operațiile anterioare, iar tratamentul cu imunosupresoare compromite vindecarea ţesuturilor.
După operație, cateterul a prezentat sânge (hematurie), dar nu s‑au făcut investigații suplimentare și nu s‑a solicitat o opinie de la urolog .
În timpul spitalizării post-natale, hematuria și simptomele dureroase au continuat, dar nici obstetricienii nu au intervenit. Cateterul a fost scos după 10 zile fără reevaluare, iar pacienta a fost externată cu durere, incontinență și anxietate crescute.
După trei săptămâni, un CT-cistogram a confirmat perforația vezicii, iar scanări ulterioare au evidențiat fistulă vezico-uterină. Pacienta a avut nevoie de cateterizare prelungită și de o altă intervenție chirurgicală pentru reparație, suferind în continuare de incontinență și durere urologică .
Impactul asupra vieții clientei
Leziunile au fost extrem de traumatice: pacienta a trebuit să plătească privat pentru intervenții chirurgicale din cauza duratelor de așteptare din NHS.
A fost dificil să își desfășoare activitățile obișnuite, să socializeze și să aibă grijă de nou-născut și de ceilalți doi copii — totul întrerupt de durere fizică și emoțională profundă .
Reclamația formulată împotriva Trust‑ului NHS
Echipa a pregătit o investigație riguroasă și a strâns dovezi medico-legale de la un uroginecolog, un urolog și un psihiatru.
Trust‑ul NHS a admis că a încălcat obligațiile de îngrijire și a recunoscut următoarele:
- neregăsirea leziunii vezicii în timpul cezarianei, în ciuda semnelor clare, fără investigații suplimentare sau opinie de urologie;
- înlocuirea prematură a cateterului;
- lipsa transferului pentru CT-cistogram după operație;
- că, dacă leziunea ar fi fost recunoscută în momentul intervenției, ar fi fost reparată imediat și pacienta ar fi evitat cateterizarea prelungită, o intervenție chirurgicală suplimentară și multă suferință .
În urma transmiterii unei Scrisori de Claim, Trust‑ul a acceptat responsabilitatea, iar cazul s‑a soluționat fără proces în instanță, printr-o compensație de șase cifre, inclusiv o plată interimară înainte de semnarea acordului final.
