Întârzierea neglijentă în diagnosticarea bolii Crohn duce la o despăgubire de £700,000
Jodi Newton, partener în cadrul firmei, a fost angajată într-un caz împotriva Maidstone & Tunbridge Wells NHS Trust („Trustul”). Clienta noastră, reclamanta în acest proces, a suferit leziuni abdominale, urologice și psihiatrice semnificative și permanente ca urmare a unei întârzieri de peste doi ani în diagnosticarea bolii Crohn.
Cum s-a întâmplat
Reclamanta s-a prezentat de două ori la medicul de familie în septembrie 2016, acuzând diaree, dureri abdominale inferioare și sângerări rectale. I s-au făcut analize de sânge și un test de nivel al calprotectinei fecale (FCP). Rezultatele analizelor de sânge au arătat un nivel scăzut de vitamina B12 și un nivel crescut al proteinei C-reactive. Testul FCP a avut un rezultat anormal de ridicat și, prin urmare, medicul de familie a trimis pacienta către Trustul pârât.
După trimitere, reclamanta a făcut o ecografie abdominală pe 19 decembrie 2016, care a fost raportată ca fiind normală. A fost efectuată și o sigmoidoscopie, dar aceasta a ajuns doar până la colonul descendent. Investigațiile efectuate – gastroscopie, sigmoidoscopie și ecografie – nu au investigat colonul drept proximal sau ileonul terminal. Astfel, investigațiile au fost insuficiente și inadecvate, având în vedere simptomatologia reclamantei, după cum a recunoscut ulterior și pârâtul. Nicio altă investigație sau revizuire nu a fost realizată, ceea ce a constituit o altă încălcare a obligațiilor medicale.
Greșelile comise de Trust sunt detaliate mai jos:
- Neaprecierea corectă a faptului că nivelul scăzut de B12 putea indica o problemă la nivelul ileonului terminal.
- Neaprecierea corectă a faptului că nivelul scăzut de B12, durerile abdominale și calprotectina fecală crescută indicau o boală inflamatorie intestinală (IBD).
- Lipsa de investigații adecvate în legătură cu simptomele prezentate.
- Neefectuarea unei colonoscopii în 2016.
- Neidentificarea bolii Crohn în 2016.
- Neinițierea niciunui tratament pentru boala Crohn.
În 2017, reclamanta s-a prezentat din nou de două ori la medicul de familie cu simptome persistente. Trustul pârât a trimis o scrisoare către medicul de familie afirmând că investigațiile au fost normale sau nu necesită acțiuni suplimentare și pacienta a fost externată. Nicio acțiune suplimentară nu a fost luată – o altă încălcare a obligației de îngrijire, după cum a fost ulterior admis de Trust.
Reclamanta a continuat să sufere de dureri abdominale și diaree, fiind liniștită în mod greșit de clinicienii pârâtului, ajungând să creadă că trebuie să se obișnuiască cu simptomele.
În 2019, reclamanta s-a prezentat la Urgențe cu dureri abdominale constante, fiind însărcinată în 27 de săptămâni. I s-au făcut ecografie, analize de sânge și RMN abdominal. S-a suspectat colită în timpul unei evaluări chirurgicale. Gastroenterologul a identificat ulterior boala Crohn ileală ca posibilă cauză, iar în urma unei întâlniri multidisciplinare, s-a confirmat diagnosticul. A fost internată din nou a doua zi, la 29 de săptămâni de sarcină, cu dureri abdominale severe și febră. Starea ei s-a deteriorat, dezvoltând sepsis. A fost necesară o cezariană de urgență sub anestezie generală și, simultan, o intervenție chirurgicală abdominală.
În lunile următoare a avut nevoie de multiple intervenții chirurgicale abdominale și pelvine complexe pentru tratarea bolii Crohn și a infecției.
Procesul juridic
Reclamanta a angajat Osbornes pentru a investiga dacă întârzierea în diagnosticarea bolii Crohn a constituit neglijență medicală.
Au fost obținute probe medicale complexe de la experți medico-legali, iar ulterior a fost emisă o Scrisoare de Reclamare.
Probele medicale au arătat că, dacă ar fi fost diagnosticată corect în 2016/2017 și ar fi primit tratament și monitorizare adecvate, reclamanta nu ar fi suferit deteriorarea bolii care a dus în 2019 la sepsis intra-abdominal, operație de cezariană de urgență și multiple intervenții chirurgicale.
Reclamanta a dezvoltat dureri abdominale, vezicale și pelvine, dureri cronice postoperatorii și durere pelvină cronică. Intervențiile din 2019 i-au lăsat deformări estetice semnificative, cicatrici dureroase, probleme de urgență urinară și intestinală, riscuri de intervenții viitoare și i s-a recomandat să evite o nouă sarcină. A dezvoltat și tulburări psihologice severe: Episod Depresiv Major și Tulburare de Anxietate Generalizată.
Nu a mai putut continua o carieră cu normă întreagă din cauza durerilor și dizabilităților, suferind pierderi financiare semnificative.
Recunoașterea vinovăției de către Trust.
În 2022, Trustul a recunoscut o serie de greșeli medicale, admise în mod formal:
- Calprotectina fecală trebuia repetată.
- Trebuia efectuată o colonoscopie.
- Trebuiau repetate analizele de sânge.
- Reclamanta nu trebuia externată fără aceste investigații.
Totuși, Trustul a negat că aceste greșeli ar fi cauzat întârzierea diagnosticului și vătămările suferite, motiv pentru care a fost necesară deschiderea unui proces în instanță.
Rezultatul procesului
Pentru investigarea cazului, s-au obținut expertize medico-legale de la specialiști în gastroenterologie, chirurgie, uroginecologie, chirurgie plastică, psihiatrie, îngrijire și managementul durerii.
Jodi Newton a reușit să soluționeze cazul obținând o despăgubire de 700.000 £, după inițierea și notificarea oficială a procesului. Deși inițial Trustul a refuzat să admită răspunderea, un acord a fost atins ulterior prin eforturile ambelor părți.
