Osbornes Law a reprezentat cu succes un minor, X, într-o acțiune împotriva a două spitale pentru vătămările suferite ulterior ca urmare a unei intervenții chirurgicale de care X a avut nevoie la scurt timp după naștere.
Contextul
X s-a născut cu probleme grave de sănătate care îi afectau organele interne. La scurt timp după naștere, X a avut nevoie de implantarea unui stimulator cardiac (pacemaker), iar câteva luni mai târziu X a suferit o operație la nivelul intestinului.
În mai multe momente, pe parcursul unei perioade de 2 ani, investigațiile imagistice au arătat că stimulatorul cardiac al lui X se deplasase, dar nu s-a luat nicio măsură.
La sfârșitul acelei perioade, X a început să se plângă de dureri abdominale și a fost tratată pentru infecții urinare, fără ca simptomele să se amelioreze. X suferea și de constipație.
X a fost văzută de un chirurg pediatru, însă nu au fost semnalate probleme. X a continuat să aibă dureri și constipație și a fost consultată de medicul de familie de două ori într-o lună; părinții au dus-o și la Urgențe (A&E).
X a avut o verificare a stimulatorului cardiac, în urma căreia s-a raportat că acesta își schimbase poziția, însă nu s-a luat nicio măsură. Părinții lui X au mers din nou la medicul de familie de trei ori în trei luni și o dată la Urgențe. La una dintre consultații, medicul de familie a cerut ca X să fie evaluată de chirurgi, dar acest lucru nu s-a întâmplat, astfel că părinții au dus-o la un pediatru privat. Aceștia au fost sfătuiți să o ducă la Urgențe, lucru pe care l-au făcut, dar li s-a spus că X are constipație și a fost externată.
Părinții lui X au continuat să solicite ajutor medical, deoarece vedeau că starea copilului nu era bună. Au mers din nou la Urgențe, însă, după ce au fost respinși, au cerut părerea unei clinici private. Medicul privat și-a dat seama că X era bolnavă și a scris o scrisoare de trimitere către gastroenterologie pentru investigații suplimentare.
Astfel, X a fost internată pentru teste, apoi externată și investigată în continuare în următoarele săptămâni. S-a constatat că X avea o infecție, dar cauza nu fusese determinată. Cardiologul lui X le-a spus părinților să o ducă la spital și să nu plece fără ca aceasta să fie internată. X a fost internată în spital.
Descoperire critică și operație de urgență
La câteva zile după internare, a devenit evident că deplasarea stimulatorului cardiac provocase leziuni grave la nivelul intestinelor lui X. X a fost transferată imediat la un alt spital. A fost efectuată o laparotomie de urgență pentru îndepărtarea stimulatorului, care perforase intestinul și migrase.
X a avut nevoie de colostomie, deoarece o porțiune din intestin era ischemică. A fost externată către secția de terapie intensivă, dar a necesitat noi intervenții chirurgicale în câteva zile.
X a fost externată pentru tratament suplimentar al intestinului. Colostomia creată a fost ulterior inversată. Din păcate, X a dezvoltat sepsis postoperator și a necesitat internare la terapie intensivă. A fost transferată din nou la celălalt spital și externată acasă câteva săptămâni mai târziu.
Recuperarea lui X a fost monitorizată ulterior, iar s-a luat decizia de a-i implanta din nou un stimulator cardiac.
Acțiunea juridică
Reclamanta a susținut că, dacă nu ar fi existat neglijența pârâților, X ar fi evitat cel puțin 10 luni de durere și suferință cauzate de compresia intestinului de către stimulatorul cardiac aflat într-o poziție incorectă. De asemenea, X ar fi evitat trauma și stresul cauzate de deteriorarea intestinului și nu ar fi avut nevoie de laparotomie de urgență și formarea colostomiei, nici de multiplele intervenții chirurgicale ulterioare cauzate de neglijență, care se presupune că au influențat negativ dezvoltarea generală a lui X și au lăsat cicatrici inutile.
Din fericire, X nu a suferit leziuni cardiace permanente ca urmare a neglijenței, însă, din cauza pierderii unei părți din intestin, este probabil să necesite o operație în viitor.
Cazul soluționat
Trustul a recunoscut răspunderea înainte de proces, iar acțiunea s-a finalizat cu succes în afara instanței. Instanța a aprobat înțelegerea privind despăgubirile pentru vătămările suferite de X, îngrijirea acordată de părinții acesteia, cheltuielile lor, precum și pentru tratamentul viitor al lui X.
