Din păcate, la un an după operație, fibroamele s-au întors din nou. Erau mici la acea vreme, așa că nu a fost necesară nicio intervenție, dar după aproape doi ani, în 2019, ea a mers la Centrul ei de îngrijire de urgență cu dureri abdominale și lombare severe. Scanarea CT a identificat două fibroame, dintre care unul foarte mare.
Ginecologul de la London North West University Healthcare NHS Trust i-a recomandat să fie supusă unei fibroidectomie pentru a îndepărta fibromul, iar intervenția chirurgicală a urmat. I s-a spus că fibroamele au fost îndepărtate cu succes.
În 2020, clienta noastră s-a întors la spital cu dureri abdominale severe și a aflat că, pe lângă fibroame multiple, fibromul mare despre care credea că a fost îndepărtat în 2019, a rămas in situ. Ea a mers la spital de mai multe ori cu dureri debilitante și a fost șocată să afle că operația pe care a suferit-o cu mai puțin de 6 luni în urmă, a eșuat și că chirurgul nu a îndepărtat de fapt fibromul.
Clienta noastră a avut acum o histerectomie cu succes, care i-a rezolvat simptomele.
Cazul nostru este că ea ar fi trebuit să fie supusă histerectomiei în loc să aibă fibroidectomia eșuată cu aproape doi ani mai devreme și că cei doi ani de durere și suferință pe care le-a suferit erau complet evitabili. Ar fi reprezentat o soluție permanentă și a fost o încălcare a obligației să nu-i ofere histerectomia ca opțiune în 2019.
În plus, pârâta nu a reușit să-i comunice că operația nu a avut succes și nu a reușit să organizeze un tratament de urmărire. În rezumat, rezecția histeroscopică a fibromului nu era probabil să aibă succes în îndepărtarea fibromului mare și foarte puțin probabil să rezolve durerea. Sfatul de a trata durerea prin rezecția fibroamelor a fost sub standard, la fel ca și intervenția chirurgicală în sine.
Am înmânat pârâtului o scrisoare în care prezentam acuzațiile privind cererea. Pârâta a negat răspunderea, însă am persistat, drept urmare pârâta a plătit clientului nostru o sumă semnificativă de 5 cifre și au fost evitate procedurile judiciare.
