Osbornes resuelve una reclamación por fallecimiento por una suma de de seis cifras

Osbornes actuó en nombre de ‘A’, quien era dependiente de ‘I’, su pareja. Habían estado juntos desde que ‘A’ tenía 13 años y en el momento en el que falleció ‘I’, ‘A’ tenía 31 años. Vivían juntos con sus dos hijos, ‘E’ y ‘M’.
El 14 julio 2015, ‘I’, quien tenía 42 años, y su esposa ‘A’ asistieron al departamento de emergencias del Hospital North Middlesex de Londres. ‘I’ se quejaba de dolor en el centro del pecho. Llevaba con dolor torácico central cuatro días. Anteriormente había padecido asma y presentaba sibilancias que persistían junto con el dolor de pecho. Había acudido a su médico de cabecera (GP) con anterioridad y le habían administrado un fármaco broncodilatador, Salbutamol.
Le hicieron un electrocardiograma y el resultado fue anormal. Trascendió que la enzima cardiaca Troponina era elevada (a 695ng/L). En urgencias le diagnosticaron con una crisis de asma y le dieron el alta con el antibiótico Augmentin, el esteroide prednisolona y un inhalador de salbutamol.
Hubo una serie de problemas cuando ‘I’ acudió al hospital:
no le hicieron el electrocardiograma a tiempo y el resultado se interpretó erróneamente; no se trató de manera adecuada el dolor torácico; no se solicitaron análisis de sangre; no se revisó la radiografía del pecho y se solicitó un segundo electrocardiograma que no se llegó a realizar.
‘I’ falleció en su lugar de trabajo varias horas después.
La autopsia confirmó que la causa de fallecimiento fue un infarto agudo de miocardio causado por aterosclerosis de la arteria coronaria. Los principales hallazgos post mortem fueron en el sistema cardiorrespiratorio. El ventrículo izquierdo (la principal cámara de bombeo del corazón) estaba engrosado debido a una afección llamada hipertrofia ventricular izquierda. Había un estrechamiento en las arterias coronarias, y el estrechamiento de dos de las tres arterias coronarias principales era igual o superior al 50%. Si bien la inspección general de miocardio (músculo cardiaco) no mostró un ataque cardiaco, cuando se realizó el corte histológico, hubo evidencia de un infarto agudo de miocardio y cicatrización del músculo cardiaco.
El informe de la autopsia confirmó la causas de la muerte como: –
- Infarto agudo de miocardio
- Aterosclerosis de la Arteria Coronaria
“Interpretación de los hallazgos
Varón caucásico de mediana edad de complexión delgada sin patología significativa en el examen externo. El examen interno mostró una fuerte congestión en los pulmones. La arteria coronaria mostró ateroma moderado. La histología confirmó un infarto agudo de miocardio además de cicatrización miocárdica y aterosclerosis en la arteria coronaria. Los pulmones mostraron características de insuficiencia cardiaca. La toxicología fue negativa.
Por ende, en el balance de probabilidades, la causa del fallecimiento fue un infarto agudo de miocardio debido a la aterosclerosis de la arteria coronaria.”
Osbornes, Socia y Responsable del Departamento de Negligencia Médica de Osbornes Law, fue instruida para interponer una reclamación. Obtuvo evidencia pericial de un cardiólogo que se utilizó para redactar una Carta de Reclamación contra el hospital. Asimismo obtuvo un informe de un psiquiatra en nombre de ‘A’, a la luz de una posible reclamación como víctima secundaria.
La parte contraria admitió la responsabilidad y Osbornes redactó un documento detallando las pérdidas (Schedule of Loss). Las negociaciones comenzaron rápidamente a partir de ese momento. Se acordó que los daños incluyeran la reclamación de ‘A’ y también las reclamaciones en nombre de sus hijos ‘E’ y ‘M’, que eran menores de edad. La compensación de ‘E’ y ‘M’ fue aprobada por el Tribunal Superior de Justicia Inglés.
