What is the Rehabilitation Code?
The Rehabilitation Code 2015 is a voluntary code of practice. It has been designed to encourage both parties to work together with the focus on the needs of the injured party – their physical, psychological, vocational and other needs.
The code centres on the claimant’s need for their rehabilitation to be fully assessed and addressed as a priority and handled on a collaborative basis. Key aspects of the code include:
- The recovery and rehabilitation of the injured person are emphasised over the financial aspects of the claim.
- It encourages the early assessment of the injured person’s needs by an independent rehabilitation expert if necessary.
- The rehabilitation code is voluntary which means that agreeing to the code doesn’t affect the legal rights of either party.
- The costs of rehabilitation under the code are usually funded by the defendant or their insurer, without prejudice to ongoing negotiations or the final outcome of the claim. The principle is that the overall cost of the claim is reduced because the injured person is more likely to recover faster with early rehabilitation.
