Settlement secured for a cyclist injured by a truck

Megan Lambert recently secured a settlement for a member of the London Cycling Campaign injured in a road traffic accident. The cyclist had right of way on a quiet road when a truck turned right across his path and collided with him, throwing the cyclist off his bike and onto the road. Witnesses called an ambulance, who attended the scene and took the cyclist to hospital for assessment.

Injuries and recovery process

The cyclist sustained a soft tissue injury to his back, a closed fracture of his right ankle and bodily grazes and bruising. He wore a boot for over a month and undertook physiotherapy to assist his recovery. He further suffered from anxiety as a result of the accident, struggling to return cycling as he once did, which was a hobby he previously enjoyed in his retirement.

Megan obtained an early admission of liability and a medical report was sought from a consultant in orthopaedics. Fortunately, the cyclist was expected to recover fully from his injuries within a year of the accident date, although further physiotherapy and osteopathy were recommended after procuring the medical report.

Settlement negotiations and court hearing

During settlement negotiations with the truck driver’s insurers, some aspects of the claim were agreed, but the offers made for the cyclist’s injuries and the care provided by his wife were significantly lower than Megan’s valuation. However, due to Megan’s diligent efforts, the case proceeded to a hearing and the Judge awarded her client £11,100, almost double the offer made by the truck driver’s insurers and in line with Megan’s valuation of the cyclist’s claim. The compensation Megan was able to secure, allowed the cyclist to have access to the physiotherapy he needed to make a full recovery.
