Aldi’s worker suffers ‘mental torture’ after the supermarket giant falsely accuses him of lying
In a shocking case that highlights the struggles faced by workers against powerful corporations, a warehouse worker endured four years of ‘mental torture’ after the supermarket giant, Aldi, accused him of being ‘fundamentally dishonest’ about a workplace accident which left him struggling to walk and with tinnitus. Despite clear evidence of his injuries, Aldi’s relentless accusations left the worker fighting not only for his health, but also for his integrity.
What happened ?
Tibor Muranyi, 56, from Derby, was unable to work for four months after his warehouse vehicle was hit by another one from behind, injuring his back.
Despite the incident being caught on CCTV and Aldi admitting breach of duty, the company claimed Tibor was lying about the severity of his injuries, accusing him of fundamental dishonesty. If proven, his fundamental dishonesty could have resulted in up to two years in jail.
Aldi eventually settled the case for £20,000 two weeks before the trial, earlier this year.
Jaro Bernat, a specialist personal injury lawyer at Osbornes Law, who represented Tibor, says defendants are increasingly making spurious claims of fundamental dishonesty against claimants.
The impact on Tibor’s life
The accusation left Tibor distraught and feeling bullied. He said: “I couldn’t comprehend why they were claiming that I was being dishonest after everything I had suffered. I had a good life before and I was happy, so there was no reason for me to lie.
I have never felt so bullied and subjugated in my life. It was like they were gaslighting me, telling me that what I had been through wasn’t true and that I was exaggerating everything.
It was a mental torture and this shouldn’t be allowed to happen. It didn’t seem a litigation, but more of a psychological war. They may think it’s just a game where lawyers battle it out, but this affects and ruins ordinary people’s lives.”
Tibor’s accident occurred at the Aldi’s warehouse in Derby in November 2020. Following the incident he struggled with back pain and developed tinnitus which affected his sleep and mental health.
Tibor said: “The accident had a devastating impact on my life, both financially and psychologically. I was constantly worried about money when I was off work and this put pressure on my relationship of six years which eventually ended. I was unable to sleep and I was generally angry.
When I went back to work it felt like they were constantly criticising me. I was expected to work at the same rate as before the accident, but I was in a lot of pain. People stopped talking to me and I felt like I was being excluded. This was mental torture for me, so I decided to leave. But when I started the legal action the mental torture continued as they claimed I was a liar.”
Conclusion and thoughts
Jaro Bernat and the team at Osbornes Law worked tirelessly to ensure that Tibor’s voice was heard and his suffering acknowledged. Jaro’s expertise in personal injury law and his unwavering belief in Tibor’s honesty played a crucial role in challenging Aldi’s unfounded accusations. His relentless pursuit of justice not only helped Tibor secure a settlement but also highlighted the importance of holding powerful entities accountable for their actions. Moreover, our client was able to find some measure of justice and begin the process of rebuilding his life.
Jaro Bernat said:
“I always believed my client was telling the truth, but Aldi subjected him to a horrific ordeal, persistently questioning his integrity to the point where he potentially faced claims of fundamental dishonesty in court. It must be incredibly difficult for the claimant to deal with this; you bring a genuine claim, but instead of waiting to receive damages, you have to fight to avoid up to two years in jail.
This is an outrageous behaviour from a corporate giant, but unfortunately spurious allegations of fundamental dishonesty are becoming a well-used tactic by defendant lawyers. I am pleased that Aldi finally saw sense and settled this claim allowing Tibor to move on with his life, but it should never have gone this far.”
