Qu’est-ce qu’un règlement financier dans le cadre d’un divorce?

Un règlement financier (financial settlement agreement) est un arrangement entre deux adultes qui ont convenu de se séparer légalement. Il est nécessaire lorsque les couples en instance de divorce possèdent un certain nombre d’actifs financiers communs. La convention de divorce est un accord juste et équitable sur le partage des actifs. Les biens suivants sont pris en compte dans le calcul du règlement financier :

  • Le domicile conjugal et tout autre bien immobilier
  • L’épargne, les investissements et les trusts
  • Les comptes bancaires communs
  • Les véhicules
  • Les actifs d’une entreprise détenue conjointement
  • Les pensions de retraite

Il couvre également la manière dont vous rembourserez les dettes et organiserez le versement de la pension alimentaire pour les enfants ou le conjoint.

Comment calcule-t-on un règlement financier?

L’article 25 du Matrimonial Causes Act 1973 énonce des lignes directrices pour le calcul des règlements de divorce. Pour parvenir à un règlement équitable, vous et votre conjoint devez fournir des détails sur tous vos biens. Ces informations doivent être “complètes et franches” et inclure tous les biens détenus en votre seul nom et conjointement ou avec un tiers. Il n’est pas recommandé d’essayer de cacher ou de dissimuler des biens.

Une fois ces informations échangées, nos avocats vous conseilleront sur vos droits et vous pourrez évaluer vos options. Ces options sont les suivantes :

  • Convenir d’un partage directement avec votre ex-conjoint ;
  • Participer à une médiation pour parvenir à un accord ;

Quel est le règlement type d’un divorce?

Il n’y a pas deux divorces ou deux situations financières identiques. Cependant, des aspects communs doivent être abordés dans une convention de divorce type afin de déterminer comment vos biens seront partagés. Cela inclut, pour les deux conjoints :

  • Leurs actifs
  • Leurs revenus et leur capacité de gain future
  • Leurs besoins financiers
  • Leur niveau de vie et leurs dépenses
  • Leur âge
  • Leurs handicaps physiques ou mentaux
  • Leurs contributions significatives au patrimoine
  • Leur comportement pendant la procédure de divorce
  • Leurs enfants.

Comment les biens sont-ils répartis après un divorce?

Le partage du domicile conjugal lors d’un divorce peut être une question complexe. En Angleterre et au Pays de Galles, le point de départ de la division des biens est l’égalité, mais il peut y avoir certaines exceptions. Le tribunal tiendra compte de divers facteurs, tels que les besoins financiers et les contributions de chaque époux, le bien-être des enfants et toute autre circonstance pertinente.

Comment les pensions de retraite sont-elles partagées en cas de divorce?

Il y a trois façons de partager les pensions de retraite lors d’un divorce : le partage, la compensation et l’indexation. Un bon point de départ pour les clients qui ont entamé une procédure de divorce ou qui prévoient de le faire est de rassembler des évaluations complètes et à jour de toutes les pensions de retraite dont eux-mêmes et leur partenaire sont titulaires.

Ai-je besoin d’un accord de règlement financier?

Même si vous êtes parvenu à un accord verbal avec votre conjoint, nous vous recommandons vivement d’obtenir un accord de règlement financier afin de vous protéger, vous et votre famille, à long terme et de garantir une répartition équitable de tous les actifs. Il s’agit d’un Financial Remedy Order qui est un règlement financier juridiquement contraignant et irréfutable, conclu par consentement mutuel et soumis à l’approbation du tribunal. Si l’affaire est contestée, le tribunal peut imposer l’ordonnance.
