Full admissions of liability secured on behalf of child with quadriplegic cerebral palsy

Jodi Newton, Partner in our Medical Negligence department and Head of Birth and Paediatric injury claims, recently secured a full admission of liability for her client “Harry” who suffered a brain injury shortly after his birth at Wrexham Maelor Hospital, operated by Betsi Cadwaladr University Health Board.

What happened?

Harry suffered neonatal collapse due to a hypoglycaemic episode (low blood glucose) at 3 days old. That condition was not recognised and managed in accordance with hospital procedures. Sadly, the failure to manage the hypoglycaemia caused Harry to sustain brain injury as a result of disruption of the blood supply to the brain (a condition known as Hypoxic Ischaemic Encephalopathy – ‘HIE’).

Harry is severely disabled, with quadriplegic cerebral palsy as a result of the HIE Grade 3 injury. He has developmental delay, severely reduced vision, and limited mobility and cognition. He requires care 24 hours a day.

Harry’s parents were understandably devastated by Harry’s injuries and instructed Jodi Newton to investigate a claim in medical negligence. Jodi obtained expert reports from medico-legal experts in the fields of neonatology, paediatric neuroradiology, and paediatric neurology in order to establish the allegation of negligence.

Admission of liability

In November 2025, approximately 18 months after they were first notified of the claim, the Health Board formally admitted the failures of care which caused Harry’s injuries. Interim payments have now been agreed totalling nearly £415,000. With an admission of liability secured, we are able to investigate the scope of the injuries and the value of Harry’s case. Harry’s needs are such that the total damages could exceed £25-30 million.

I hope that with the interim funds we have achieved, this enables them to secure his future, pending the final settlement of Harry’s case.”
