Serious burn injuries are among the most physically and psychologically demanding personal injuries to recover from. Treatment can involve months in a specialist burns unit, multiple skin-graft operations, permanent scarring and disfigurement, and long-term psychological therapy. Even moderate burns can leave lasting sensitivity, scarring and loss of function.

Categories of burn injury we see most often
Burn injuries are classified clinically by both the agent that caused them and the depth of tissue damage. The combination determines treatment, recovery time and the value of the claim.
Thermal burns. By far the most common category. Caused by contact with hot surfaces, boiling liquids, steam or open flames. Typical settings are commercial kitchens, hot-water systems at work, defective domestic appliances, scalding in care settings, and house fires. Scalds account for the majority of burn injuries in children.
Chemical burns. Caused by strong acids, alkalis, bleach, solvents and cleaning products. Most chemical burns happen in factory and industrial settings where workers handle hazardous substances. Inadequate PPE, training failures and missing eye-wash facilities are common patterns.
Electrical burns. Caused by current passing through the body from faulty wiring, live equipment, overhead power lines on construction sites, or defective consumer products. Electrical burns often look minor on the skin but cause deep internal injury along the path the current took. Cardiac complications are a recognised risk.
Burn depth and severity. Burns are classified by depth: superficial (first-degree), superficial-partial-thickness (second-degree), deep-partial-thickness, and full-thickness (third-degree, going through to fat, muscle or bone). Full-thickness burns invariably need skin grafts and leave permanent scarring. The percentage of total body surface area (TBSA) affected drives the seriousness of the medical case, with anything over 20% TBSA classed as a major burn.
Where serious burns happen
- Accidents at work. The single biggest cause of burn-injury claims. Factory, construction, catering and chemical-industry settings carry the highest risk. Employers must provide PPE, training and a safe system of work under the Health and Safety at Work etc Act 1974.
- Defective products. Faulty appliances, exploding e-cigarette batteries, defective heating equipment and contaminated cosmetic products give rise to product liability claims under the Consumer Protection Act 1987.
- Beauty and cosmetic treatments. Burns from waxing, laser treatments, hair-dye chemical reactions and ill-fitting sunbeds are a recognised category of claim against beauty salons and clinics.
- Road traffic accidents. Fire and explosion in serious collisions, contact with hot vehicle surfaces and chemical exposure from leaking fuel.
- Clinical negligence. Burns from electrosurgical equipment, diathermy, hot-water bottles in care, and inadequate temperature control of heat packs during physiotherapy can give rise to a clinical negligence claim.
Do I have a burn injury claim?
You can usually make a claim if:
- Someone else owed you a duty of care and breached it (an employer, occupier, product manufacturer, healthcare provider or other road user)
- Their breach caused or contributed to your burn injury
- The accident happened in the last three years (or the date you became aware your injury was caused by their negligence)
If you were partly at fault you may still claim under contributory negligence. Children have until their 21st birthday. Where a burn injury resulted in death, the claim must be brought within three years of the date of death.
What a burn injury claim is worth
Your settlement has two parts. General damages compensate for the burn itself, the pain and suffering, and the permanent scarring. Special damages cover financial losses including reconstructive surgery costs, lost earnings, future loss of earnings, psychological therapy, equipment and home adaptation. For severe burns, special damages can be substantial because rehabilitation often lasts years.
The Judicial College Guidelines value burn injuries across multiple chapters because burns can affect any part of the body. The most commonly applied brackets for the visible scarring aspect (from the 17th edition, April 2024) are:
- Minor facial scars: £2,080 to £4,310
- Moderate facial scars: £4,820 to £16,770
- Significant facial scars: £11,120 to £36,720
- Serious facial scarring: £21,920 to £59,090
- Very severe facial scarring (cosmetic effect very disfiguring, severe psychological reaction): £36,340 to £118,790
For body burns, the bracket varies with the body area affected, the percentage of TBSA, and the severity of scarring and functional loss. Burns to the hand or affecting a major joint typically attract higher awards because of the functional impact. Severe burns over more than 40% TBSA can reach six-figure general-damages awards and are valued case by case. Current 18th edition figures (April 2026) are approximately 8% higher, and your final valuation will reflect inflation to the date of assessment.

Three-year time limit and date of knowledge
There is a three-year time limit running from the date of the burn injury, or from the date you first knew your injury was caused by a negligent act. The same three-year limit applies whether the cause was an accident, clinical negligence or a defective product. If the injury resulted in death, the claim must be brought within three years of the date of death or the conclusion of the post-mortem.
