Significant Damages for Disrepair secured following breach of Court Order

Our client approached Osbornes Law having previously brought a disrepair claim with another law firm. Works and damages had been agreed as part of the earlier settlement agreement, but her local authority landlord had failed to undertake the works. Her property was suffering from a leak and significant damp and mould.

A further letter before claim was sent, to ensure any additional items of disrepair were covered, and the parties agreed to instruct a surveyor as a single joint expert. The works in the expert report were quickly agreed, however the landlord failed to provide the additional evidence the expert required to form an opinion on the thermal capacity of the roof.

Successful negotiations and resolution

Following lengthy negotiations, a decant for the client was agreed for the duration of the works and the additional evidence requested was provided to the expert. Damages were agreed at more than three times the original damages sum, despite the timeframe being significantly shorter, and it was not necessary for the client to go to court.
