Osbornes Law secures a six-figure settlement for a cyclist injured following a violent collision

Andrew Middlehurst, a lawyer in the specialist cycling injuries team at Osbornes Law, recently settled a claim for a cyclist in the region of £200,000.

What happened?

The cyclist was on his way home from work and was crossing a slip road which was part of a cycle route. As he crossed the slip road a car collided with him throwing him violently from his bike.

The cyclist suffered very serious injuries including a head injury, fractured knee, punctured lung, fractured clavicle, injuries of the spleen and kidney and a fractured finger. Whilst in hospital he was admitted to intensive care for a lengthy period following a cardiac arrest.

The insurers agreed to pay for private rehabilitation including a physiotherapist and a psychologist.

Expert advice secures settlement

To better understand the long-term impact of the injuries sustained, Andrew arranged for the cyclist to be examined by a very experienced knee surgeon and was in the process of arranging several other medical experts to investigate the medium to long-term impact of the injuries when the insurers made an early offer of settlement.

Andrew brought a barrister on board from a leading Chambers to consult on the case and provided further tactical advice in order to assess the early offer.

Despite the limited available medical evidence the cyclist was given thorough advice on the risks involved and the different aspects of valuing a claim such as his, including compensation for his injuries, out of pocket expenses and future financial losses.

With the benefit of the advice procured by Andrew, a settlement was reached soon afterwards. This brought the matter to a conclusion less than 18 months after the collision.
