Cyclist hit by van driver
Eloise Mears, a solicitor at Osbornes Law, recently secured a £75,000 settlement for a cyclist who was injured in a road traffic accident. The cyclist, a previously fit and healthy gentleman in his 70s, was riding his usual route to work when he was struck by a van driver at a junction.
Cyclist sustained a traumatic brain injury
Despite the cyclist wearing a high visibility jacket and a helmet, the van driver failed to avoid him and collided in a T-bone collision. The cyclist sustained a traumatic brain injury as a result of the accident. Eloise was instructed to make a personal injury compensation claim, as the severity of the injury meant that the cyclist could no longer continue his driving job, despite making a very good recovery from the initial head injury.
Rehabilitation and Support
Eloise worked closely with the van driver’s insurance company, who agreed to fund a Rehabilitation Case Manager. The case manager assessed the cyclist’s immediate needs and arranged for therapeutic treatment, including household adaptations to support his recovery.
Despite the insurer not admitting liability for the accident, they made an early and favourable offer to settle the case. The cyclist chose to accept the offer, which allowed the matter to be resolved quickly and provided him with the financial resources to move forward with his life.
