Sophie Davies, Head of Personal Injury at Osbornes Law, has shared her perspective on the mounting pressures facing claimants and the lawyers who represent them, in a cover feature published by the Law Society Gazette.

The article, written by journalist Catherine Baksi, examines a growing access-to-justice crisis affecting people harmed by the negligence of others. Despite injuries caused by negligence continuing to rise, personal injury claims have fallen by around 60% over the past decade – a trend the piece attributes to a combination of legal aid cuts, reforms to the civil justice system, and an increasingly hostile environment for claimants.

Speaking to the Gazette, Sophie discussed the impact of fixed recoverable costs (FRCs) on the sector. She explained that the fees allowed under the fixed costs regime were pitched too low from the outset and have failed to keep pace with inflation since.

Sophie also raised concerns about the conduct of some defendants and insurers, noting there is little to deter unreasonable behaviour, including the growing use of unmerited “fundamental dishonesty” allegations against genuine claimants.

Sophie Davies later commented:

“Behind every claim and every statistic is a real person, often a family, dealing with the consequences of an injury that should never have happened. Access to justice must remain at the heart of the personal injury system.”
