Pedestrian hit by a car claims substantial compensation
If you are a pedestrian and were knocked over by a vehicle when crossing the road without having looked properly before crossing, you may think you will not be entitled to bring a compensation claim. This is not the case – a driver has a higher duty of care than a pedestrian and if the driver of the vehicle was going over the speed limit, even if the pedestrian dashed out without checking, the pedestrian will likely still be entitled to compensation, although their compensation would be reduced to take into account their own “contributory negligence.”
Successful Compensation Claim
Siobhan McIvor, Partner in the Personal Injury Department has recently successfully settled a pedestrian accident claim, managing to persuade the driver’s insurers to increase from a derisory first offer of a couple of thousand pounds to a substantial lump sum.
Additional Support for Victims
The driver’s insurers also agreed to fund private medical treatment for our client who had sustained some nasty orthopaedic injuries, which private interventions greatly assisted our client’s recovery.
Our Commitment to Clients
At Osbornes Law we strive to ensure we obtain the highest possible compensation award for every client – we don’t give up when faced with a difficult case and we don’t advise our client to settle until we are absolutely sure we cannot push the insurers any higher.
