Separating a child from their parents: why courts must carefully consider all the evidence

Disputes involving young children can be highly sensitive and complex, particularly if parents face the prospect of a child being removed from their care.

Occasionally, judges do make wrong decisions and the parents may be able to bring a prompt appeal. Recently, for instance, the Court of Appeal found that a family judge had wrongly authorised the separation of a 6-year-old from his parents.

In a reassuring decision for any parent, the appeal judges made clear that ordering a child’s removal at an interim stage before all the evidence has been considered, can only be ordered when the child’s safety demands it and it is necessary and proportionate.

What’s the background?

In B (a child)(Interim Separation) [2026] EWCA Civ 748, the local authority received reports over several years from concerned parties about the care of a young child (B) (now 6). The parents did not live together. Concerns had been raised about the mother’s mental health and unhygienic living conditions, as well as both parents’ drinking, substance abuse and alleged domestic abuse.

In February 2026, the local authority began care proceedings and in May, the judge ordered B’s removal under an interim care order – though he did say the case was “finely balanced”.  There were, for instance, positive features around the father’s care of B in recent days which all parties had recognised – but the judge did not refer to this in his judgment.

The guardian immediately appealed and the judge stayed the order. The Court of Appeal has allowed the appeal, criticising the judge for not adequately explaining why those positive features were insufficient to protect B in the interim. He should also have explained why the balance came down in favour of B’s immediate removal to foster care.

The application for an interim care order was sent back to the family court for a rehearing. As for the immediate arrangements for B’s care, the court made a child arrangements order that he would live with his father for now, and that the mother would have regular contact three days each week. The father was also granted parental responsibility for B.

What does this mean?

It was made clear that any proposal to remove a child from their parents under an interim order before the evidence is fully considered, can only be justified if removal is necessary and proportionate. “It is a serious step which requires a careful and rigorous analysis”, the judges added.

The decision should be reassuring for any parent who is concerned that their child may be removed under an interim care order. The courts are expected to apply established legal principles, otherwise an appeal is likely to succeed.

It is also reassuring for any parent determined to turn their life around for the sake of their child. The clear efforts made by the father to confront his own difficulties and make positive changes in order to care for B – even over a short space of time – were finally recognised and taken into account (at least, at this stage).
