Mr B’s Successful Claim for Personal Injury and Financial Loss

Mr. B, a sales executive, sustained injuries after tripping over a raised kerbstone on Upper Street in Islington. As a result, he suffered soft tissue injuries to both his back and shoulder.

Following the incident, we were instructed to pursue a claim on Mr. B’s behalf. Through our investigation, we determined that the area where the accident occurred was under the responsibility of Transport for London. After presenting this information, Transport for London admitted liability for the unsafe kerbstone. We then secured a medical report from a Consultant Orthopaedic Surgeon, detailing the extent of Mr. B’s injuries.

Mr. B underwent private treatment and fortunately made a full recovery. However, the impact of the accident went beyond his physical injuries. As a high earner in a demanding sales environment, Mr. B had not taken time off work, but the injuries significantly affected his performance. This, in turn, led to lost commissions and bonuses, resulting in substantial financial loss.

To support his claim, we prepared a detailed witness statement from Mr. B and gathered evidence from his employer, substantiating the loss of earnings. After negotiations, we were able to secure a total settlement of £10,327.17 for Mr. B. This included a significant award of over £6,500 specifically for his loss of commission.
