Osbornes a ajuns la o înțelegere în numele unui client ce a inițiat o acțiune împotriva NHS Trust pentru asistența medicală neglijentă care i-a fost acordată în timpul unui transplant de rinichi în 2018.
Clientul, sportiv profesionist, s-a născut cu Sindromul Alport, o afecțiune genetică, moștenită de la mama sa; caracterizată prin boli de rinichi, pierderea auzului și anomalii oculare.
În 2018, reclamantul a avut nevoie de un transplant de rinichi din cauza insuficienței sale renale, iar tatăl său, în vârstă de 41 de ani, a fost identificat ca fiind donatorul potrivit. Reclamantul a urmat transplantul de rinichi cu rinichiul donat de tatăl său.
În astfel de intervenții, există întotdeauna o perioadă scurtă în care rinichiul este lipsit de sânge și prezintă riscul de deteriorare progresivă. Riscul este mare atunci când rinichiul este cald, deoarece problema rămâne activă metabolic în acest moment. Pentru a minimiza acest risc, rinichiul trebuie răcit rapid pentru a reduce activitatea metabolică și pentru a menține funcția sa.
Cu toate acestea, tatăl reclamantului a fost diagnosticat cu trăsătură de celule falciforme și aglutinine reci, ceea ce pune rinichiul la un risc ridicat de deteriorare în timpul unui transplant. Pentru pacienții cu acest sindrom, odată ce rinichiul este îndepărtat, acesta trebuie perfuzat cu volume mari de lichid de perfuzie cald pentru a elimina sângele donatorului și, prin urmare, toate aglutininele reci. După care, ar trebui să fie răcit în mod convențional.
În acest caz, unul dintre chirurgii implicați era conștient de anticorpul reactiv la rece al tatălui, dar nu a prezis că va avea un efect dăunător asupra transplantului. Nu este clar dacă ambii chirurgi erau conștienți de starea tatălui. Chirurgii nu au perfuzat rinichiul tatălui cu apă caldă; în schimb, au racit imediat rinichiul după ce a fost scos din corp.
Rinichiul nu a funcționat în urma intervenției chirurgicale, iar reclamantul a fost informat că, dacă medicii ar fi cunoscut de antiaglutinina reactivă la rece, ar fi efectuat mai întâi curățarea caldă, înainte de spălarea cu apă rece.
Solicitantul a cerut un nou transplant de rinichi de la donator viu, care a avut loc în cele din urmă la sfârșitul lunii decembrie 2020.
Ca urmare a intervenției chirurgicale eșuate, reclamantul a suferit o pauză în cariera sa sportivă și ar fi revenit la forma fizică completă până la jumătatea anului 2019. El nu ar fi avut nevoie de tratament suplimentar, inclusiv nevoia de retransplant. De asemenea, nu ar fi suferit o reducere anticipată a speranței de viață.
Osbornes Law a trimis notificarea prealabilă pârâtului în mai 2021.
Acuzațiile împotriva departementului din cadrul NHS au inclus, dar nu s-au limitat la:
- Eșecul de a avertiza reclamantul cu privire la afecțiunile de sânge ale tatălui său;
- Eșecul de a discuta despre prezența aglutininelor donatorului și a trăsăturii celulelor falciforme cu un hematolog consultant înainte de transplant;
- Eșecul de a lua în considerare sau de a atenua riscul de aglutinare și hemoliză legat de aglutininele reci ale donatorului și, respectiv, de trăsătura celulelor falciforme sau de a avertiza tatăl sau clientul despre posibilitatea complicațiilor asociate.
Răspunsul la notificare a fost primit de la pârât în ianuarie 2022. Trustul a recunoscut că echipa renală nu a discutat despre prezența aglutininelor reci în sângele tatălui cu departamentul de hematologie. Ei au recunoscut că, dacă ar fi avut loc o astfel de discuție, ar fi avut ca rezultat o modificare a metodei convenționale de curățare (adică rinichiul donatorului ar fi fost perfuzat mai întâi în lichid cald). Acest lucru, la rândul său, ar fi ajutat la evitarea eșecului în transplantul de rinichi.
În urma admiterii răspunderii de către Trust, pârâtul a făcut o ofertă în valoare de £140.000. Osbornes a prezentat o contraofertă de £165.000, iar apoi pârâtul a prezentat o contraofertă de £160.000 plus costuri rezonabile, care a fost acceptată de reclamant.
Reclamantul a fost mulțumit de rezultat, suma compensand anii de carieră ratați din cauza stării de sănătate și a impactului pe care l-a avut asupra carierei sale în viitor.
