Compensación por daños psicológicos secundarios
Laura Swaine consiguió ganar una reclamación de un cliente que presenció un terrible accidente en el que se vio implicada su mujer. Una víctima colateral es la persona que presencia el accidente de la víctima directa o lo que sucede inmediatamente después. En los casos de lesiones personales puede tratarse de un ser querido quien presencia el accidente de tráfico o su resultado.
El cliente vio un árbol caer encima de su mujer
El cliente vio un árbol caer encima de su mujer. Iba andando por Ashdown Forest con su mujer y su perro. Habían estado en el centro de visitas hablando con uno de los voluntarios antes de salir al bosque. Había tres arboristas trabajando cerca, pero no había señales que indicaran que las rutas dentro del bosque estuvieran cortadas y no había zonas acordonadas. Nuestro cliente y su mujer estaban a unos 100 metros del centro de visitas cuando escucharon a alguien gritar y un árbol le cayó encima. Vio cómo caía un árbol grande sobre su mujer y la dejaba inconsciente.
Se aceptó responsabilidad directamente
La aseguradora aceptó responsabilidad en ambos casos directamente. Estaban dispuestos a proporcionar tratamiento psicológico a nuestra víctima colateral para ayudar en su recuperación. Tras el tratamiento, nuestro cliente estuvo encantado de aceptar el acuerdo.
