Personal injury rules in England and Wales have changed. From small claims limits to fixed costs and whiplash tariffs, find out how the updates affect your claim.

Recent updates to personal injury law in England and Wales have fundamentally altered the process for certain claims, how much compensation you might receive, and which claims qualify for legal support.
Whether you’ve been hurt in a road accident, at work or through medical negligence, it’s important to understand how these changes may impact your claim.
Small Claims Track Expanded for Road Traffic Claims
In England and Wales, all personal injury claims are allocated to a “track” based on the value of the claim. The small claims track previously had a limit of £1,000 for all injury damages – this has been raised to £5,000 for road traffic accident claims. The increase means that more people with RTA-related injuries, like whiplash, must now follow the small claims track.
Small Claims Official Injury Claim Portal
If your claim falls within the small claims criteria, you’ll typically need to manage your claim through the Official Injury Claim (OIC) portal. This is a free online service run by the Motor Insurers’ Bureau, and you must use it if all of the following apply:
- Your injury happened in a road accident in England or Wales after 31 May 2021
- You were a driver or passenger in a motor vehicle (not motorcycles)
- Your injury damages don’t exceed £5,000
- Your total claim, including other losses, doesn’t exceed £10,000
- You’re over 18 years old
No Recovery of Legal Fees
The OIC portal is intended for claimants to use themselves, without a solicitor. This is intentional as legal fees are no longer recoverable from the defendant’s insurer under the small claims track. Many solicitors no longer accept these claims on a no win, no fee basis because these changes mean the sums don’t justify the work.
If you need legal help but fall within the small claims track, some solicitors will assist on a limited basis or for a fixed fee. It’s worth exploring your options and being clear about costs from the outset.
Exceptions for Vulnerable Road Users
The small claims track expansion and OIC portal do not apply to cyclists, motorcyclists, pedestrians or other vulnerable road users, such as horse riders and those on mobility scooters. These groups stay under the original £1,000 limit.
The distinction exists because vulnerable road users face greater injury risks when hit by vehicles. A pedestrian hit by a car might suffer fractures that can’t be valued through the online portal. Their claims move to standard court procedures, which means claims over £1,000 follow a different pathway and claimants can recover legal costs if they win.
Different Tracks for Larger Claims
Not all cases are small claims. If your injury claim exceeds £5,000 (£1,000 for vulnerable road users), it follows a different pathway and different procedures apply.
Fast Track for Mid-range Claims
Fast track cases involve claims between £10,000 and £25,000. They are structured to finish relatively quickly, with trials limited to one day and expert evidence restricted to one expert per side. After allocation to the fast track, the court sets a relatively snappy timetable for the claim. The entire process, from beginning to end, should take no longer than 9-12 months.
A significant new development is the Fixed Recoverable Costs (FRC) system. Since October 2023, the legal costs a winning party can recover from the losing party are capped at set amounts, determined by how complex the case is. This provides certainty and proportionality of costs, but it can mean successful claimants pay their solicitor more than they recover from the opponent. Most fast track personal injury cases use no win, no fee agreements to manage this.
Intermediate Track – The New Middle Ground
Introduced in October 2023, the intermediate track is a relatively new addition. It applies to claims valued between £25,000 and £100,000 where the cause of action (usually the accident date) occurred on or after 1 October 2023. If your accident happened before this date, your claim will be allocated to either the fast track or multi-track, depending on its value and complexity.
The intermediate track was created to bridge the gap between fast track and multi-track claims and provides a more proportionate procedure for moderate-value cases. Trials are limited to three days, and oral expert evidence is restricted to two experts per party. Like the fast track, it sets a cap on the legal expenses that can be recovered from the losing party.
Multi-Track for Complex and High-Value Cases
If a claim doesn’t fit the fast or intermediate track, it goes to multi-track. Claims valued above £100,000 and those with complicating factors, such as more than two defendants, will be allocated to this track. Some claims go to multi-track automatically, including mesothelioma and asbestos-related disease claims, clinical negligence cases (unless liability is admitted), and cases involving harm to children.
There are no restrictions on trial length or the number of expert witnesses in multi-track cases, and the judge will actively manage the case through conferences and pre-trial reviews. Legal costs aren’t fixed in this track. Instead, there is a detailed costs assessment to determine what the losing party pays the winner, and the amount can be contested if it seems unreasonable.
Changes to Personal Injury Compensation
The Whiplash Tariff System
On 31 May 2021, compensation for whiplash injuries was fixed at a set amount based solely on the injury’s duration. In 2025, the tariff was increased, with the current amounts shown below:
- Up to 3 months: £275 (£300 with minor psychological injury)
- More than 3 to 6 months: £565 (£595)
- More than 6 to 9 months: £965 (£1,025)
- More than 9 to 12 months: £1,510 (£1,595)
- More than 12 to 15 months: £2,335 (£2,435)
- More than 15 to 18 months: £3,445 (£3,550)
- More than 18 to 24 months: £4,830 (£4,975)
Injuries lasting longer than two years fall outside the standard tariff award and are calculated the same way as other personal injury compensation.
The tariff has made whiplash claims much less valuable for claimants – awards are now up to 80% lower than pre-reform compensation amounts. This is intentional on the part of the government whose goal was to reduce fraudulent claims and lower insurance costs.
The Ogden Discount Rate
For catastrophic injuries requiring lifetime care, the Ogden Discount Rate determines how much lump sum compensation is needed to provide the injured person with an income to pay for future care. The Discount Rate represents the expected return the claimant is likely to earn by investing their compensation payment in a low-risk portfolio.
This rate changed in January 2025 from -0.25% to +0.5%. The higher rate means claimants will receive a lower payout, because it’s assumed the money will grow enough to cover future needs.
For example, suppose a disabled child needs £150,000 annually for 60 years. Before January 2025, a lump sum of £9.7 million would be needed to achieve this. After the rate change, that same need is valued at £7.76 million – a reduction of roughly £1.96 million.
