Pedestrian hit by an e-scooter rider claims £25,000

This case study highlights how Osbornes Law secured a £25,000 settlement for a client injured while riding an e-scooter. It shows the importance of specialist legal advice in e-scooter accident claims.

Incident Details

The pedestrian had been walking to their car when the rider, unlawfully riding a private e-scooter, collided with her. The pedestrian was thrown to the ground and sustained significant injuries. The e-scooter rider fled the scene, and the police failed to trace them.

Compensation sought from Motor Insurers Bureau

Road users that sustain injuries as a result of collisions with unlawfully ridden e-scooters are entitled to approach the Motor Insurers Bureau (MIB) to seek compensation for their injuries. The law classes private e-scooters being ridden on public land as motor vehicles requiring insurance. As the e-scooter rider fled the scene without providing details, they were considered to be an ‘untraced’ driver of a motor vehicle.

Negotiated settlement reached

The MIB were persuaded to accept the case and compensate the pedestrian. Medical reports were obtained from a number of relevant medical specialities to better understand the long-term impact of the injuries sustained. Andrew calculated the full extent of the financial impact resulting from the injuries, including the costs of further medical treatment. The MIB made offers of settlement and entered negotiations. A settlement was reached, bringing the matter to a conclusion and allowing the pedestrian to move on with their life.
