Settlement for secondary psychological injury

Laura Swaine recently settled a claim for a client who witnessed a horrific accident his wife was involved in. A ‘second victim’ is the person who witnesses the primary victim’s injury, or the immediate aftermath. Our client witnessed his wife being hit by a falling tree. Our client was walking in Ashdown Forest with his wife and their dog. They had been in the Visitors Centre speaking to one of the volunteers before they left to go into the forest.

Tree surgeons were working nearby but there were no signs to say that any of the routes within the Forest were closed off and no areas were roped off. Our client and his wife were approximately 100m from the visitors centre when they heard someone shout as a tree fell towards them. Our client saw a large tree fall on his wife knocking her unconscious.

Liability accepted straight away

The insurance company accepted liability on both cases straight away. They were eager to provide psychological treatment for our secondary victim to aid his recover. Following this treatment our client was happy to agree settlement.
