Екипът по клинична небрежност в Osbornes Law наскоро споразомя случай, при който нашата клиентка е получила сериозни наранявания в резултат на клинична небрежност по време на раждането на първото си дете през ноември 2018 г. Нашата клиентка беше представлявана от Ник Лийхи, адвокат в екипа по клинична небрежност.
История
Нашата клиентка, AB, забременява в началото на април 2018 г. и се записва за акушерски грижи в Princess Royal University Hospital (PRUH) на 9+5 седмици. PRUH се управлява от фондация NHS Foundation Trust на King’s College London Hospitals. Бременността на AB се счита за нормална и с нисък риск. Тя посещаваше всичките си предродилни прегледи, както е планирано, и няма никакви притеснения по време на бременността.
На 17 ноември 2018 г. АБ се обажда на родилната телефонна линия и съобщава за силни контракции. Казват й да дойде в родилния център за преглед. Тя пристигна малко след това и в 14 часа е забелязано, че е в латентна фаза на раждането. Планът на този етап е да се продължи с наблюденията, CTG изследяване, спекулум +/- вагинален преглед и да се организира акушерски преглед, ако това е необходимо.
Малко по-късно, в 15:00 ч. на 17 ноември 2018 г., е установено, че AB има 5 см разкритие и е направен план тя да бъде преместена в родилния център, за да изчака. По това време е решено тя да се наблюдава консервативно.
В 19:10 раждането е установено от акушерката, тъй като AB има силни контракции в този момент и изисква облекчаване на болката. Планът е AB да има рутинни интрапартални грижи, облекчаване на болката, ако е необходимо, и орална хидратация/грижа за пикочния мехур. Фетален мониторинг се извършва след всяка контракция преди предаването на смяната на нощния персонал приблизително в 20:30.
До 20:50 AB има контракции 3-4 пъти на всеки 10 минути с продължителност 55 секунди, леко до умерено при палпация. Усещат се добри движения на плода. Към 21:00 тя е с 6 см разкритие.
AB остава в родилния център през нощта на 18 ноември 2018 г. В 03:00 ч. е започнат профилактичният прием на бензилпеницилин, 24 часа след като тя започва да изтича околоплодна течност. По-късно в 05:00 часа е взето решение за усилване на раждането със Синтоцинон. По това време тя все още е с 6 см разширение.
В 11:40 ч. е направен повторен преглед на А.Б. Контракциите й са станали по-силни и по-чести от рано сутринта. По това време тя е с 9 см дилатация, което е значителен напредък. Има развитие на капут и върхът остава над седалищните шипове. Въпреки това е взето решение раждането да продължи и АБ да бъде прегледана отново след 2 часа.
До 13:40 няма по-нататъшен напредък по отношение на разширяването на шийката на матката. Въпреки това, AB има силни контракции и това е с честота 4 на всеки 10 минути. Има все повече доказателства, че раждането се възпрепятства по това време и има caput +++. Въпреки това, не е извършен преглед от старши акушерски персонал и не е взето решение за раждане на бебето чрез спешно цезарово сечение към този момент.
Едва в 15:55 регистраторката в отделението направи влагалищен преглед и шийката на матката е разкрита с 9 см. По това време има нормален CTG, но се повишава изходното ниво и е взето решение да се премине към цезарово сечение.
На 18.11.2018 г. в 17:30 ч. е направено спешно цезарово сечение. AB е с 9 см разширение, когато е преместена в операционната. Процедурата почва в 17:35 и се стига до матката в 17:38.
В 17:46 е отбелязано, че AB има трудно раждане и че има признаци на затруднено раждане. Забелязан е пръстенът на Bandl. В резултат на трудното раждане хирургът трябва да направи Т-образен разрез на матката на AB и дъщеря й в крайна сметка е родена в 17:46.
Бебето на AB е прието в SCBU след раждането и AB трябва да остане в болница, тъй като собственото й възстановяване е трудно. Тя страда от следродилен сепсис и илеус. В крайна сметка AB е изписана от болницата на 30 ноември 2018 г. Въпреки това тя се връща в болницата на 6 декември 2018 г., страдайки от продължаваща следоперативна болка. Приемат я и й дават антибиотици. По този повод тя остава в болница до 11 декември 2018 г.
Горните събития имат сериозен неблагоприятен ефект върху последващата бременност на AB през 2020 г. Планът за тази бременност е тя да роди в 36 гестационна седмица, поради проблемите, които е имала при предишната си бременност. За съжаление, тя е приета със силна коремна болка в 31 гестационна седмица и диагностицирана с руптура на матката, което налага незабавно да роди бебето си. Оттогава тя е посъветвана да избягва да има още деца.
Граждански иск
Никълъс Лийхи, адвокат в екипа по клинична небрежност в Osbornes, беше инструктиран от AB през декември 2020 г. да предяви иск срещу King’s College Hospitals NHS Foundation Trust.
След първоначалните разследвания бяха получени експертни доказателства от водещ акушер-консултант, който подкрепя случая на AB относно нарушение на задълженията и причинно-следствена връзка. Нашият експерт беше на мнение, че въпреки ясните доказателства, че раждането на AB е възпрепятствано, е налице небрежност, и не само да се предложи на AB да продължи със спешно цезарово сечение, но и да се насърчи това като най-безопасната опция в обстоятелствата. В резултат на тези грешки, нашият експерт смята, че раждането при AB е по-сложно и че при липсата на значителни грешки в грижите, AB не би изисквала разрез с обърната Т или обратна екстракция на седалищната област.
Иск беше изпратен до болницата през октомври 2021 г. и отговорът беше получен на 1 март 2022 г. Ответникът направи значителни признания за отговорност в своеят отговор и ни покани да изпратим списък на загубите в опит да постигнем споразумение на нейния случай.
Доказателствата за състоянието и прогнозата бяха получени от консултант по пластична и реконструктивна хирургия, който посъветва различни възможности за лечение за намаляване на белезите на AB, които бяха по-обширни, отколкото биха били, ако не беше допусната небрежност. След получаване на това доказателство, на ответника беше разкрит напълно подробен график на загубите. Бяха направени предложения за уреждане и ответникът прие предложението на AB за уреждане по член 36 през април 2022 г. на стойност £85 000.
