The Polish workforce in the UK

Polish nationals have been arriving in the UK in significant numbers since 2004, when Poland joined the European Union and its citizens gained the right to live and work here freely. More than twenty years on, the Polish community is one of the most established and well-integrated in the country, with an estimated 750,000 to 1 million Polish speakers living in England and Wales. There are large communities in London, Birmingham, Manchester, Leeds, Nottingham and Peterborough, as well as in many smaller towns and rural areas.

Polish workers have become an integral part of the UK economy. The sectors where Polish nationals are most heavily represented, including construction, logistics, food processing, agriculture, hospitality, healthcare and cleaning, are the same sectors where the risk of a serious workplace accident is highest. Polish nationals are among the most represented nationalities on UK building sites, they make up a significant share of HGV and delivery drivers, and they are well represented in the food processing and manufacturing sector where machinery injuries are a regular occurrence.

This matters when it comes to personal injury claims, because UK compensation levels are calculated differently from how they would be in Poland. Poland operates a civil law system, and compensation for personal injury there is typically lower than what courts in England and Wales would award for the same injury. Accidents at work

Workplace accidents are among the most common reasons Polish nationals contact us. UK employers have a strict legal duty to ensure the safety of their workers, and where they fail in that duty and someone is injured as a result, the employer can be held legally responsible.

Polish workers are disproportionately represented on construction sites across the UK. Building and civil engineering work carries inherent risks: falls from height, falling objects, scaffold collapses, trench accidents, and injuries from power tools and plant machinery are all too common. Shops, supermarkets, restaurants, pavements, parks, car parks and other public spaces all carry a legal duty of care towards people using them. If that duty is not met and you are injured, through a wet floor with no warning sign, uneven paving, a poorly maintained entrance, or a hazard that should have been identified and dealt with, you may have grounds for a claim.

No win no fee, what it means for you

We handle almost all personal injury claims under a Conditional Fee Agreement, which is what most people mean when they say no win no fee.

Can I speak to a solicitor in Polish from the start?

Yes. Osbornes Law has Polish-speaking solicitors and legal staff who will handle your case in Polish from first contact through to the conclusion of your claim. You will never be asked to communicate in English if you prefer to use Polish.

How long do I have to bring a personal injury claim?

The general time limit for personal injury claims in England and Wales is three years. This usually runs from the date of your accident. In some circumstances, for example if you did not immediately connect your symptoms to a specific incident, or if you were dealing with a long-term condition caused by your work, the three years may run from a later date. There are also different rules for children. It is important to seek advice early, as evidence is easier to obtain close to the time of the accident.

Does my immigration status affect my right to claim?

No. You do not need to be a British citizen or have any particular immigration status to bring a personal injury claim in England and Wales. The right to claim compensation for an injury caused by someone else’s negligence applies regardless of nationality or immigration status. Most Polish nationals living in the UK hold settled or pre-settled status under the EU Settlement Scheme, but even this is not a requirement for bringing a claim.

I was injured doing informal or cash-in-hand work. Can I still claim?

Yes. The nature of your employment arrangement, whether formal, informal, through an agency, on a zero-hours contract, or cash-in-hand, does not prevent you from making a personal injury claim if you were injured because of someone else’s negligence. Do you act for clients outside London?

Yes. Our offices are in Camden and Hampstead, but we act for Polish-speaking clients across England and Wales. The majority of the claims process is handled remotely, by phone, video call and email. You do not need to be in London or to travel to our offices.

What if my employer says the accident was my own fault?

This is common, and it does not mean your claim will fail. In many cases, both parties bear some degree of responsibility, a principle called contributory negligence, and compensation can still be awarded, potentially at a reduced level.
