£70,000 Settlement for Cyclist

Incident Details

The cyclist entered the roundabout when the driver of a van collided into the cyclist’s right-hand side, throwing him to the ground and causing injury. The cyclist sustained serious fractures to his hip and wrist, requiring surgery to fix both fractures with metal plates.

Insurers Accept Liability

The van driver’s insurers were persuaded to accept liability for the collision and agreed to fund private rehabilitation and treatment for the cyclist. Following the recommendation of an orthopaedic consultant, Andrew secured funding from the insurers for a surgical procedure to remove the metal plate in the cyclist’s hip, which initially led to improvement.

Cyclist required hip replacement

A medical report obtained from a specialist hip surgeon identified a serious complication and recommended a hip replacement. Funding was obtained from the insurers to pay for a robotic-assisted total hip replacement. The insurers also made an offer of settlement. Andrew brought an experienced barrister on board, and comprehensive advice was given to the cyclist in a meeting on the potential value of their claim based on the limited evidence available.

Settlement and Outcome

A settlement was reached, securing compensation for pain and suffering, financial losses incurred, and the potential costs of future private medical treatment. The settlement allowed the cyclist to move on with their life.
