How habitual residence affects child abduction cases
Where a parent takes a child from the UK and fails to return them, the left-behind parent may apply to the court for an order requiring the child’s return. However, child abduction cases are often complex and emotionally challenging, and a return order is not guaranteed.
The recent case of Re A (A Child) (Habitual Residence) [2026] EWHC 1140 (Fam) demonstrates the importance of the concept of habitual residence when determining whether the English courts have jurisdiction to order a child’s return.
The facts of the case
In Re A, the child was a British citizen but had spent a significant proportion of his young life living in India. The court concluded that, by the time proceedings were commenced, the child was habitually resident in India rather than England and Wales.
The case serves as a reminder that nationality and citizenship are not determinative of habitual residence. A child may be a British citizen and yet be habitually resident in another country.
The decision also highlights that, even where a child was previously deeply integrated in the UK, subsequent circumstances may demonstrate that their habitual residence has changed.
Why habitual residence matters
International child abduction cases are often governed by international treaties such as the 1980 Hague Convention on the Civil Aspects of International Child Abduction, which provides a framework for securing the prompt return of children who have been wrongfully removed or retained abroad.
Where the country to which the child has been taken is not a signatory to the 1980 Hague Convention, or the 1996 Hague Convention on Jurisdiction, Applicable Law, Recognition, Enforcement and Co-operation in Respect of Parental Responsibility and Measures for the Protection of Children, an application may instead be made under the court’s inherent jurisdiction.
In such cases, the court must determine jurisdiction by reference to the Family Law Act 1986. A key question will be where the child was habitually resident when the proceedings were issued.
How is habitual residence determined?
Habitual residence is a question of fact. The court will consider all of the circumstances of the child’s life and that of their family, with particular attention paid to the child’s degree of integration within a country.
Relevant factors may include:
- Where the child has been living;
- The duration and stability of their residence;
- Schooling and educational arrangements;
- Family and social connections;
- The child’s day-to-day life and activities; and
- The intentions and circumstances of the parents, where relevant.
No single factor is decisive. The court must undertake a holistic assessment of the child’s circumstances to determine where their life is centred at the relevant time.
What does this mean for parents?
Re A demonstrates that habitual residence can change over time and that courts will focus on the reality of a child’s life rather than their citizenship or nationality. Parents involved in international relocation, retention or child abduction disputes should seek specialist legal advice as early as possible, as jurisdictional issues can significantly affect the outcome of a case.
