The background
Our client has required assistance from carers for several years due to a pre-existing condition. He lacks sensation in his lower limbs and is therefore he is not able to recognise skin breakdown or alert his carers to it. His carers were therefore responsible for checking his lower limbs for any redness and signs of skin breakdown, as well as applying barrier creams to prevent this.
His family had raised concerns about the quality of care he was receiving but no corrective action was taken by the care agency.
In October 2021, our client was out for the day with his family when they noticed he was limping. District Nurses were called out to visit him and they found a large area of dead tissue on his heel. Our client was admitted to hospital with an infected heel ulcer measuring 6cm x 7cm. He was at risk of needing an amputation but thankfully, this was not required. He did however have to undergo two debridement procedures and have a prolonged hospital stay.
Our client’s ulcer has never fully healed; he has endured a continuous cycle of improvement and deterioration over the last three years. Unfortunately, he has been unable to return to work ever since.
The outcome
A Letter of Claim was sent to the private care agency. They categorically denied liability but following a robust Letter of Challenge served by Osbornes, the case was settled in our client’s favour.
