Changing Solicitor to Osbornes

There are many reasons why you might want to change from using your current solicitor. At Osbornes we ensure that if you make this decision, we will handle all aspects of the move on your behalf, to include telling your previous solicitor you no longer want them to act for you, and arranging for your papers to be transferred.

It may be that your calls are never taken or your emails go unanswered. Or faced with endless unnecessary form-filling, you get the impression no one understands your predicament. It may be that the “solicitor” appointed by your insurance company is not a qualified solicitor at all, or questions are answered in a prevaricating manner. You might just not like them.

Whatever the reason for wanting to change your solicitor, you have the right to choose who represents you, and the right to choose someone else if things aren’t working out.

Ben Posford at Osbornes specialises in complex compensation claims. He is used to being contacted by claimants and their families, often in some distress, unsure whether they are getting the right advice or not from their existing solicitor.

Ben is always happy to discuss your concerns with you in confidence and without charge. His mobile number is 0753 922 6767 and his email address is benposford@osborneslaw.com.

Complex claims

Complex claims are generally those involving compensation awards in excess of £25,000, and include both physical and psychological injuries.

In some cases, claimants are receiving the correct advice from their current solicitor, but it hasn’t been explained very well.  Sometimes however inexperienced lawyers attempt to undertake complex cases without having the experience or knowledge to handle them well enough. In these circumstances it can be disastrous to stay with your current solicitor.

Insurers acting for defendants have almost unlimited resources at their disposal to defend complex claims, and only hire experienced lawyers to act for them. If your own solicitor lacks sufficient experience, not only will they fail to understand your rehabilitation and therapy needs, but their opponent will take advantage of their inexperience.

Insurers know if their solicitor isn’t up to the job, but unless you’ve suffered a serious injury before, it will usually take longer for you to start voicing your concerns.

If in doubt, ask about your solicitor’s experience or see what you can find out about them independently with a Google search.

And if you don’t get a straight answer to your questions, call Ben.

A Success Story

Michael’s daughter suffered a severe brain injury in a road traffic collision. He contacted a well-known solicitor who advertised on the television in his area, and they referred him to a local solicitor. The solicitor knew little about the type of rehabilitation Michael’s daughter needed, and even less about the type of expert reports required to secure a compensation award would last her whole lifetime and fund all the care, therapy, accommodation and support she would need.

The defendant was represented by a well-known lawyer who acted for insurance companies in complex cases, and they saw an opportunity to dispose of the claim as cheaply as possible.

Michael contacted Ben Posford just before having to decide whether to accept a settlement offer from the defendant for £253,000. Following an initial discussion on the phone and then a family meeting with Ben, Michael decided to change solicitor.

Michael’s daughter ended up with a compensation award well in excess of £2 million. When the case had ended, Michael said Ben Posford has supported and guided us through easily the most traumatic event in our lives with a compassion and empathy that has been unwavering. He has without exception put our daughter (his client) first in all discussions and deliberations and I cannot think of a single occasion where he has not been immediately available to us either by phone or email, which has inspired enormous confidence in him.”
