In some cases, claimants are receiving the correct advice from their current solicitor, but it hasn’t been explained very well. Sometimes however inexperienced lawyers attempt to undertake complex cases without having the experience or knowledge to handle them well enough. In these circumstances it can be disastrous to stay with your current solicitor.
Insurers acting for defendants have almost unlimited resources at their disposal to defend complex claims, and only hire experienced lawyers to act for them. If your own solicitor lacks sufficient experience, not only will they fail to understand your rehabilitation and therapy needs, but their opponent will take advantage of their inexperience.
Insurers know if their solicitor isn’t up to the job, but unless you’ve suffered a serious injury before, it will usually take longer for you to start voicing your concerns.
