An arm injury can be painful and restricting, especially if it affects your dominant arm. You use your arms for almost everything, so even a minor injury can impact the things you take for granted such as driving, washing or holding your children.

Each year, over 100,000 people experience distal radius fractures. This is a common arm injury where one of the two long bones in the forearm breaks close to the wrist. Many more experience sprains, cuts, burns, dislocations and carpal tunnel syndrome, showing just how common arm injuries are.

Sprains, strains and muscle ruptures –often caused by overstretching, lifting heavy objects or repetitive strain from work or sports, muscle tears (ruptured bicep) and soft tissue injuries can be very painful. They often need long periods of rest to fully recover, which can be difficult when you need to use your arms every day.

Fractures – the humerus, ulna, radius or clavicle (collarbone) can all be broken in accidents such as falls or road accidents. These injuries can take months to heal and may need surgery, leaving you unable to work or carry out daily tasks.

Dislocations – dislocations occur when the bones of a joint are forced apart, causing pain and immobility. Simple dislocations do not generally require surgery. However, when fractures and torn tissues are also present, surgery is often necessary to repair the damage and to reduce the chance of elbow or shoulder instability.

Burns – the arms and hands are frequent places for burns to occur since they are among the more exposed parts of the body. Burns range in severity, and sufferers may experience significant psychological distress alongside the physical injury.

Repetitive Strain Injury – RSI is an umbrella term for musculoskeletal injuries caused by repetitive actions. Prolonged and repeated movements can cause damage to tendons, muscles, ligaments or soft tissues of the arm, causing chronic pain and weakness in the affected area.

Hand-arm vibration syndrome – Also known as vibration white finger, hand-arm vibration syndrome is an industrial injury caused by constant use of vibrating handheld machinery. If left untreated, it can cause permanent numbness and loss of dexterity in the affected hand.

Crush injuries – crush injuries occur when a limb is crushed between two objects, for example, in a workplace machinery accident. They can rank among the most serious injuries, often requiring multiple surgeries or even amputation.

What are the common causes of an arm injury?

Many arm injuries are sustained on the road.

According to the Royal Society for the Prevention of Accidents, 40% of cyclists injured in a bicycle accident sustain an arm injury. Pedestrians are also vulnerable to arm injuries since they have no protection in a collision.

Accidents that happen during sports and slips, trips and falls in a public place may also result in an arm injury. It is natural to put your arms out when you fall to protect your body, and the impact of hitting the ground can cause fractures and dislocations.

Arm injuries at work are also common. They fall into two categories:

  • Arm injuries that result from exposure to workplace hazards over a period of time. For example, carpal tunnel syndrome and repetitive strain injury commonly affect office workers who perform repetitive work like data entry and vibration white finger affects workers who use vibrating power tools at work.

Am I eligible to make an arm injury claim?

In general, you can make a claim if:

  • You were involved in an accident in the last three years
  • The accident was caused by someone else’s negligence
  • You suffered an arm injury as a result

How is arm injury compensation calculated?

Personal injury compensation aims to put you back in the position you were in before the accident happened. It cover two separate aspects of your arm injury:

  • Pain and suffering. Known as ‘general damages,’ this is the amount of money you will receive for your injury itself, including how much pain it has caused you and how long it will take you to recover. The more severe and long-lasting the injury, the higher the amount of general damages you are likely to receive.
  • Financial losses. Known as ‘special damages’, this is reimbursement of the expenses and financial losses your arm injury has caused you or is likely to cause you in the future. Special damages might include:
    • Lost earnings due to time off work
    • Anticipated lost future income, if you can no longer work at your current salary
    • Medical treatment
    • Physiotherapy
    • Travel costs
    • Modifications to your home or vehicle

How much compensation can you claim for a broken arm?

Solicitors and judges use a variety of tools to help them decide the value of an arm injury claim. One of those tools is the guidebook to personal injury compensation published by the Judicial College. The book distils previous personal injury awards into a series of tariffs which solicitors use as a starting point for settlement negotiations.

To give you an idea of the range of awards for arm injuries, here are some current guideline amounts:

  • Simple fracture to the forearm – £6,610 to £19,200
  • Moderate vibration white finger where it’s possible to work – £8,000 to £16,000
  • Moderate arm injury with some recovery – £19,200 to £39,170
  • Severe arm injury with permanent disablement – £39,170 to £59,860
  • Loss of one arm below the elbow – £96,160 to £109,650
  • Loss of both arms – £240,790 to £300,000

The figures are for guidance only and relate to the general damages aspect of a claim. They do not include the monetary value that can be added for financial losses such as loss of earnings.

How long do I have to claim?

In most cases, you will need to make your claim within three years of the accident or when the condition was diagnosed.
