A man who suffered a serious head injury as a passenger in a car accident has been awarded with compensation to provide long term rehabilitation for the injuries sustained.
At the time of the accident he was not wearing a seatbelt and therefore the insurer representing the driver argued that he was partly to blame for the severity of his injuries and sought a 25% reduction in his level of compensation to reflect this. This was eventually reduced to 15%.
As a result of the accident the man suffered a serious head and brain injury as well as a fractured neck and pelvis. He continues to require support from a therapy and case management team.
