Six figure Sum Awarded Following Medical Negligence Claim9 Jul 2015
Stephanie Prior, Head of Medical Negligence at Osbornes Solicitors has successfully negotiated an out of court six figure medical negligence claim settlement for her client who suffered from negligent medical treatment administrated by an NHS Trust.
The client underwent a left total knee replacement which resulted in severe nerve damage to her knee and left her in acute pain. The injury left the client unable to continue working in the job she had enjoyed before the treatment. The injury also had a huge impact on her family life; she required care and domestic assistance from her immediate family members, has gross mobility issues and is only able to walk for short distances.
Although initially denying liability and negligence, after lengthy negotiations and Court proceedings, Stephanie secured a six figure sum for the client, which takes into account past and future loss of earnings, the pain suffered, past medical cares and physiotherapy and travel expenses.
“The effect that this injury has had on my client has been totally life changing; she went from a working mother of three children and wife to a husband who himself suffers from poor health, to being highly dependent on her family to care for her. The surgery left her suffering from what she described as the worst pain of her life and she continues to be reliant on painkilling drugs to manage the pain”.

In this case because liability was not immediately admitted by the particular trust, the claims process and time to settlement took longer, which was of course extremely distressing for our client and her family, only adding to the stress and pain which was already under. I am happy that settlement has now finally been achieved without further Court proceedings and that our client and her family can move on with their lives.
Of course no amount of money can turn back the clock, but this medical negligence claim is a stamp of recognition that an avoidable mistake has been made and goes some way to assist my client in living as independently as possible”.
