Recommendation to regulate Wills probate and Estate administration industry 13 Aug 2019

All firms offering will writing and estate administration should be regulated to protect consumers from falling victim to ‘cowboy companies’ who offer badly drafted and potentially legally incorrect documents.

The Legal Services Board (LSB), which has the job of overseeing the regulation of lawyers in England and Wales has found there to be systematic problems with the services delivered by many different types of provider offering will writing and estate administration services. The catalogue of issues they found were sloppiness in drafting, errors, pushy sales attitude and in some cases clients have simply been stolen from!

The LSB have recommended regulation as they feel it will protect consumers from bad companies whilst at the same time allow reputable companies to offer services alongside solicitors.

Osbornes would advise individuals who require a will or other estate services to look for a firm that is a member of a professional body, find out how long the firm has been operating and clarify what protection is in place should the firm go into administration.
