Eviction from home of vulnerable man during lockdown prevented 22 Dec 2020 | William Ford

Osbornes were instructed just before the lockdown to prevent the eviction of a vulnerable man with capacity issues.

He had accrued rent arrears of around £10,000 as his benefits had been stopped. He was living without gas and electricity due to his inability to manage his affairs.

We arranged a capacity report which confirmed he suffered from brain damage with specific impairment in learning and recalling information. Shortly after, the possession order was set aside as it had been made during a period in which he lacked capacity.

He is now also being assessed by social services.

If you are at risk of being evicted from your property, the housing team at Osbornes can help and can often make urgent applications on your behalf. To speak with one of our specialist housing lawyers please call us or fill in an online enquiry form and we will call you back.
